I have a really close friend that married a US Citizen and had two kids with her. They have been married about 2 years. My friend caught her cheating on him with another man. They are currently separated because she left him with the two kids and moved in with this other man. To top it off, she is now 8 months pregnant with the other man's child. She left him with the two kids and said she did not want any part of the marriage anymore.

He has to go back to immigration in February 2010 to get his permanent green card. He currently has the temporary one and he is scared that this may keep him from getting his permanent green card. He wants to file for a divorce and full custody of the children but he is not sure how this would effect him.

Does anyone have any advise for him?

first of all, your friend must be devastated. God's speed on his recovery from this and moving on

second:

i'm not sure of what exactly he should do in this case

but i do know that its not an automatic denial if he's divorced/separated

he DOES need to carefully compile evidence that while the marriage was going well they were living as a married couple

so bills with their names, credit cards with their names, etc

and i suppose if he can show that his wife has abandoned him and not the other way around, maybe he will stand a good chance

but again i am not sure of what exactly the procedure is

Am a bit confused,or let me be honest am very confused, they are married for two years and have two kids? as if thats not tough enough (timeline wise) she isnow 8 months pregnant with another mans baby? ohh my God!!!!!!. How is this possible? your timeline doesnt make much sense to be honest.

As regards advice,i would say he should get a lawyer and look at his options.

First - he really needs to talk to a lawyer.

He should get divorced, and then he can file for himself (since he has the CGC) - all he has to prove is that the marriage was entered in good faith. (having children is a good sign - plus - are they both USC's?).

As soon as the divorce is final, he can apply to remove conditions (not wait for the 90 days till the CGC expires).

As long as he can prove the marriage as mentioned above - he should be able to get the GC. (plus he probably would have some sort of hardship going on, since he has both children)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

wow, how crazy! I have a friend that kinda endured the same thing. My friend applied and he had recieved a paper stating that he had been approved for a green card, but he didnt want to have any problems so he informed an immigration lawyer that he is seperated, has custody of their child, and that the grounds for divorce were: Physical and mental abuse, she got pregnant by another man, and child endangerment. the lawyer told him that b/c he was abused by a US citizen that he will be able to continue with his petition.

what would my friend be able to do? just to make sure that the lawyer wasnt trying to just get money outta him...

Let me shed some light to your confusing. My friend did not come in to the country through a k1 visa. He came in on a visitors visa and/or a student visa. I am not sure which one. Anyway, during his time here he married a woman and was married to her about 2 years but there was some complications with his application. Apparantly they felt the marriage was not valid. This cause massive delays. During this time they divorced and he met another woman. I personally believe he did not give himself enough time. He fell in love with his wife and they began the process all over again. They had been together 6 month to a year before they got married. Honestly this woman is a baby factory, she has 2 kids from a previous marriage, 2 kids with my friend and 1 on the way from another. I hope this clears up your confusion.

Your friend should be fine, he needs a good attorney to handle his divorce and custody issues. ASAP

As others have posted, he can file for divorce and after the final judgment of divorce is issued he can file to remove conditions, with copies of children's birth certificates, divorce judgment, etc.

:wow: I am truly sorry for all the things your friend has gone thru....but I think the best advice I can give is for him to consult a lawyer with this matter....I feel he has a good case though because she left him and he has the kids...but check it out to be safe!
