My wife got the 10 year green card base on her previous marriage. She divorced last year. I know it is difficult for me, a F1 student, to file a green card at this time but what should we do? Should we wait until she get naturalization ( it takes 1 more year), gather as many evidences as possible to tell USCIS that this is not a fraud marriage? We came to each other at the beginning of this year. I has been 6 months and we have some evidence of living together such as joint lease contract, joint checking account, sharing my credit card to my wife with her name on her card, car insurance, CD account showing both our name, lots of pictures during the last 6 months, car title showing both our name. It is real so I am confident of maintaining and having more such evidences. I am still with my school and will maintain my legal F1 status in America at least in 3 years. Somebody tell me to wait but some tell me file i-485 right now and wait. Either way i have to wait but i may get EAD, SSN or International student tuition fee waived if I file i-485 right away. Together with those benefits would be so many times of getting inforpass ( every 3 months). I heard some also have problems of renewing driver license due to long time ( more than 1 year) of pending document. If someone was on my same case or have experience on this, please share!

AOS from F-1 Timeline

(based on marriage to USC)

2010-06-16 Send I-130 and I-485 packages

2010-06-17 arrived at Chicago lockbox (express mail service was quick, it took less than a day)

2010-06-24 Checks cashed

2010-06-26 Received NOAs for 1-130, I-485 and I-765 (EAD)

2010-07-09 I-130, I-765 touched

2010-07-23 Call USCIS to request Bio. letter. Gotta wait in 45 days for another call

2010-08-18 EAD touched

2010-09-03 Biometrics letter received. Scheduled on 09/13/2010

2010-09-07 Successful walk-in biometrics

2010-09-07 EAD card production order. I-485 touch <-- 8 hours after biometrics done

2010-09-08 I-485, EAD touched

2010-09-16 EAD card and interview letter scheduled on Oct 18 received.

2010-10-18 interview- Got RFE-RFE sent same day!

2010-10-22 GC production notice received!<-- Application approved!!!

2010-11-01 GC received, See USCIS again in next 2 years!

Can marry, however it is easier for you to adjust status after she has citizenship.

If your F-1 and studies allow you to wait until then I would wait until she has citizenship BEFORE filing I-130+I-485.

If you file before citizenship, the I-130 goes into limbo, and the I-485 cannot be filed based on this I-130.
