I am a Canadian living in Windsor, Ontario and my fiance is an American living in Detroit, Michigan. He literally lives closer to me than my place of employment so this process has been very frustrating for us.

We got engaged and immediately filled out the paperwork for the K1 fiancee VISA. Over time, we learned about all of the immigration restrictions under this VISA (travel especially and also the period of waiting before I can work in the USA) and these restrictions prevent us from living the lives we would like to live. For instance, I will be teaching abroad in four different countries over a period of twelve months commencing this September. We estimate that my interview at the Embassy will be either this month or in the month of July. After reading a lot on visajourney.com, entering the USA on the K1 VISA and then traveling for a long period of time could cause a lot of issues.

My fiance and I have discussed this and feel that it might just be the best for us to withdraw our application. What do you think about this? Are there any better immigration options for us? Is there any way around this dilemna with the K1 VISA?

We are currently at the last step of the process and just waiting for our interview at the US Embassy in Montreal, Quebec.

Does anyone know what to do or who to contact about withdrawing our application?

The USC will need to contact USCIS to cancel the petition. Usually they will require a notarized notice of cancellation.

I don't know what visa you could go for if your going to be jumping around to different countries for a year. You may want to do that first, before you plan on doing a visa to come to the US.

There really isn't anyway to get around the time requirement - with the travelling and all.

Will your fiance come with you during your that period?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You can send a certtified letter to the consulate. In your case and with the ease of travel for Canadians/USCs, the K-1 is a particularly bad choice. I live 43 miles from Montreal and cannot imagine having a finacee/wife from there that wouldn't be able to travel home 43 miles to see family for 2-6 months. You should get married in either country and file for a CR-1. You can visit in the meantime and will be free to travel before and after issuance (except you must still go to an interview)

Why do you want to cancel it? you can just put it on hold. just call the embassy or make an appointment with them and explain it to them.
