Maybe. What status does it say online?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Don't worry about it. It should arrive to you shortly...if you are at VSC they are giving the NOA2's for people in January now. I just got mine last week. Technically we have to wait 6 months before saying anything and then if we STILL haven't gotten anything, THEN make a stink.

And don't pay attention to the USCIS website. They don't really update it very often. Mine still says they haven't looked at since the last day of January.

We're in the same boat guys. It seams like they really don't care about the stress caused by this procedure. I've already gone nuts. It not for the job that I have that allows me to visit my family once a month and financially support them and me, I think I would be in a nut house by now.

We have an NOA1 date of Jan 16 2009 and have heard nothing from the California Service Center. After seeing a large number of NOA2 come from California for couples who submitted their I-129 up to several months after we have I contacted my Congressman. My Congressman contacted CSC who replied with "call us back if after 6 mos. you still have no NOA2". So much for first come, first served...

Another frustrating point is that from Jan. through April there was a large number of NOA2 coming out of the CSC. Since around the beginning of May it has slowed to a crawl - supposedly due to the fact that they are now processing H1B work visas. Another sore spot with me...

I know you may not like to hear this because I did not when I was in your status...just be patient a few more weeks. It took 5 months and 2 days for me to get the NOA2 from the effective date of the NOA1. I nwould think you should be getting your NOA2 within the next 2 to 3 weeks. Looik at the processing times here on VJ and you can get an idea from that.

It will take upto 6 months for your NOA2... you might be blessed with a RFE rather then a NAO2. if you get a RFE, add few more months to your NAO2.

I got my NAO1 in December 08, got my RFE in April 09. I sent my RFE back in May09 and i've been waiting and waiting for my NAO2. RFE says i have to give them 2 months (July09) before I panic and call them to inquire.

RFE: April'09

NAO2-email: July'09
