My husband and I are going to file through DCF for CR-1 visa, we are about to do the I-130 package. I was told in the past I need to be one of the joint sponsors (I-864 Affidavit of Support) for my husband regardless who the other person was sponsoring him, but I am living abroad in the United Kingdom - so doesn't that mean I don't qualify for that as I do not have a US Domicile?

So does that mean I STILL have to fill out the I-864 or can he have another sponsor from someone else in my family who DOES have a US Domicile?

Domicile and residence in I-864 are two different things.

Domicile is something like your parmanent address (US), and residence is your mailing address where you actually live (UK).

(Somebody, please correct me if I am wrong.)

For DCF, the petitioner has to file I-864 no matter what and show that the domicile is in the US.

Documents needed for that are a US bank account, US driver's license, US voter registration, US credit card, etc.

If your income in UK is not continuous in the US, you need a joint sponsor.

Thanks for clearing that up for me!!!

My next question is.. does the I-864 cost money to file? and if so does it cost for both my joint sponsor and me or just one fee? or none? Thanks in advance :)

USCIS doesn't require a fee, however, the State department does when it is reviewed domestically. (so filed abroad, no fee)

If a fee is required, each 864 needs it's own fee.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Nope, you don't need to pay any fee for I-864.

The only fees we have paid/will pay for DCF are $355 at the time of the I-130 petition and $400 ($355 for application fee + $45 for security surcharge) at the time of the beneficiary's interview.

Domicile is where u want to spend your future and if it is not usa then u need to attach a letter of explanation with the I-864.

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg
