Hello well here is the good news. I received my approval notice today. My case showed enough evidence i Pose no rosk to my wife. ADAM WALH WAS DEFEATED. Adam walsh filers rest at ease, :dance:

Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN Current Status: Approval notice sent.

On June 2, 2009, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

I worked very hard on this case. With polygraphs, letters from family memebers. I will work very hard this week for others to know my portfolio of what I sent to get this approved this week. Peaple that prayed for us thank you sooo much. God bless you all.

Congradulations and thank God! i know that you have been through a lot and it is significant to see that you have completed this part of the process and have been successful. i truly wish you strength and insight into the next chapter in this ordeal. may God continue to bless you guys...

i am just about to submit my response to my NOID and we shall see what the future will bring. i am one of those men who committed an offense against a minor and i am a convicted sex-offender. i must register quarterly for the rest of my natural life. i too trust that the LORD will do what is best and that i have the courage to accept what will come. :)

As for the responces I have recievedd back thank you for those kind blessing. I do have the next step of this process to continie the National Visa Center. I hope they are kind with my past! what was advised to me is that maybe in the interview they feel they can try scareing my wife in the interview. or maybe not My wife knows and they also know she knows.

Now another whole battel begins with this process. Does anyone know how long this next stage will be? we are just a normal I-130 petiton at this point.

The tough obstacle has been overcome. From now on, the process should move on the usual schedule. Whether the issue comes up in the interview, it will not be a problem especially if you are present at the consulate to show how sincere you both are.

When we went for our initial interview (for the I-130, not the I-175) they didn't allow my husband to come in. They told me about his criminal history and wanted to verify that I knew. They asked how I found out, how I reacted, and why I decided to stay with him. The officer was very nice and seemed just to want to make sure I was entering into the marriage with knowledge about his background. He never did interview us together but approved us on the spot (although this was before AWA was passed). If you've made it through this first step, then USCIS has confirmed that you are not a danger to your wife and I agree with Old Dominion - things should proceed like any other case. Good luck!

Being present for the interview helps the CO resolve any doubts about the validity of the relationship. I was within earshot of the interview, and in fact was asked a sarcastic question from a distance because of age difference. The CO didn't really want an answer, of course.

Yes the interview will be my #### tearing if anything about my past. That is why it will be very important I'm present in the interview with my wife. But then again they know my wife knows. We have a plan for this already set up in case they do try this route to scare my wife away. We are prepared for the scared tactics they will play in the interview.

That will most likely be avoided if possiable.

Shane, thanks for posting your process here and I wish you the best in bringing your family together.

I was directed to this forum (your thread in particular)by a employee from a immigration consulting firm.

I am a RSO and my fiancee and I had been waiting patiently for me to get off probation, so I could travel to meet her in person for the first time, she is from Phils and we have known eachother for almost 2years now, and had planned on being married. After much prayer and preperation and court dates ,I was granted early temnination of my probation. Pretty much unheard of here in Florida for a sex offender.

Our victory over this hurdle came to a screeching halt when I discovered the AWA's impact on a petitioner for a family based visa. My fiancee and I were initally heartbroken, But I have contacted over 50 immigration attorneys,none offering any real hope, until I was directed here. Sorry I do NOT want to hijack this thread! I will post my own plight later.

I just wanted to THANK YOU for letting your story be known and the information you have passed on,and continue to I hope. It is invaluable, and is a ray of hope that me and my fiancee have desperately needed.

Read the part where they look at your behavior from the time of completing your probation or sentence. There must be a significant passage of time of good behavior between the time of completing your probation and sentence prior to petitioning your spouse. This is put in a better wording.

My advice my friend is find a good Polygraph and get a great polygraph score and result you have not committed any other sexual convictions. Get a certificate of completion of treatment alone with a great review from your therapist you are not a person to be suspected to commit any sexual violence with your significant other or partner. A letter from your wife or partner she is aware of your offence. Get involved with a community volunteer program quickly. This is all about you can do at this point. You have one major weakness my friend. The time presents of your crime, and being on probation still.

I do not mean to discourage you but only give you great advice. You and your partner are in my prayers. Do not let this Adam Walsh act scare you. Because you seen now it has been beat. Anything is possible, but take my advice. (I have spent many nights studing the system and finding the weakness to beat this law and over come the ACT of ADAM WALSH.

to be more clear, my crime was in 2000, I was convicted in 2001. I did 2yrs house arrest , to be followed by 10 yrs S.O. probation that would end in oct 2013.

I completed S.O. treatment, that included polygraphs every 6 months ...i did this for 6 years.

I was let off probation early, June 10 2009 :dancing:

I will take your advise about a new poly and letters, voulenteer work is pretty hard for a RSO to do here.

First Im flyin my butt to Phils to give my girl a big hug and kiss for the first time, since its required we meet in person within 2 years no matter what petition we go with

then I will come back here and work my tail off to make everything happen......Im very much considering marrying her in phil on a future trip. instead of doing the K-1 that we originally planned.

The Adam Walsh petition will come to rest this week. Our expedite request was approved. Bogota received it today and scheduled and interview for September, 8. That was quick... WOW amazing how things all moved fast after a expedite process.

Please pray for us our interview goes well. This has been a tough road.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
