Renewal of EAD during Pending AOS

Hi All,

Questions on Renewal EAD, I-765, it's really confusing and my wife needs to work! (we're trying to save and buy a house :( )

We have pending AOS for Permanent Residence (I-485), waiting almost a year for an interview (waiting for a response on "No Criminal Record" next steps, which is another story in itself :bonk: ).

1) Do we have to pay the fee ($340) again?

>The instructions are confusing, but I believe we qualify for the fee waiver under ( c ) (9) "Adjustment applicant who filed for adjustment under the fee structure implemented July 30, 2007" because our AOS/I-485 was submitted in May 2008 and we have NOA's as proof of application pending.

2) The form asks for "Current Immigration Status" would my wife's be just Adjustment of Status?

>Or Pending Permanent Residence? Or is it still K-1 Fiance?

3) The form also asks for "Manner of Last Entry" would this be Advanced Parole (I-512L)?

>My wife went out of the country for a month a few weeks ago, with her Travel Visa/Parole document, and returned with no issues.

Timeline

You should not have paid the $340 the first time, EAD is based on pending I-485 and is part of the $1010 paid for the I-485.

Renew the EAD based on the I-485 and attach a copy of I-485 NOA1 letter, and a copy of expiring EAD, and pay NO FEE. Code is (C )(9 )

Is now a US Citizen immigration completed Jan 12, 2012.
