I-134 Question - Proof

So, got the the NOA2 and letter from consulate awhile ago; so quick we didn't have the paper work ready.

My fiancee is finishing up getting police certificates, certificate saying she can marry and all that (one more trip back to her hometown I believe). I'm finishing up getting paperwork done on my side and am going to FedEx it to her in the next few days to a week.

I'm filling out the I-134 Affidavit of Support now. I got a letter from my company which is quite a bit over the poverty level. I got 3 years worth of tax receipts from the IRS. I have a letter from my bank with how much I have there (they couldn't tell me how much total had been deposited over the last year). Actually, I now have several thousand more in the account. Is this good enough?

I figured I would on the I-134 put my updated savings account information and attach an internet printout. I also have some stocks in my 401K, so I put that down and will include a printout. Finally, I have life insurance through my work but don't really know how to prove that.

Am I okay? I think I should be since the work is well over the amount and so the rest shouldn't be a big deal.

Real pain getting the letter from my work; took them multiple weeks. Had to talk to their employment lawyers or something. It made me think, "maybe they don't want to give me a letter because they are going to lay me off." I guess not fortunately.

Sounds like you are OK on income alone. I left all the asset information blank. They were reluctant to give you the letter because sometimes attorneys are hired to sue them and claim the letter is some sort of lifetime gaurantee. It isn't, but the lawyers suing just want to get 30% of a nuisance settlement. Many employers simply won't give a letter and it is optional anyway. You should be fine with stating your income and supporting with the letter and some recent check stubs. Bank information is also optional and you can verify deposits by copies of statements.

Had my bank refused this, I would change banks immediately. Unlike an employment letter it is a statement of facts of MY account and money in their institution and they damn well better be able to tell me what I deposited in the last 12 months. I am a customer of the bank, not an employee. Fortunately my bank is service oriented as they should be and I had no problem. In fact I wrote the letters (employment and bank) myself and took them in, said "please type these on letterhead and sign these...I'll wait while you do it" I had both of them in minutes.

The directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq/0,,id=199557,00.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

Also I highly recommend that you join and use "A Candle for Love" The consulate in Guangzhou tends to deny visas to those who are not prepared. http://candleforlove.com The FAQ there will prepare you for what is to come.

Thanks a lot. Sounds like I should be good then.

I guess I should check out for candleforlove.com. Something about the design and colors annoy me though.

Also, seemed like too many horror stories that I got sick of reading and were a little scary (though their evidence of relationship seemed weak, had only been one visit, quick proposal, etc, compared to my 2 year relationship with 4 visits - and soon to be a fifth this summer). Better to be over-prepared though.
