Do we fill out the G-325A form (each) or the DS-320 or both? (aren't they both biographic forms?)

Also, do we copy the forms once we have filled them out? (comes with 4 copies, the G-325A but says only fill one out?) If both, do we both fill out a DS-320 or just the petitioner?

And on the bottom of the G-325A where it says "This form is being submitted in connection with an application for" would I tick "Other" and write DCF or CR-1 or would I tick "Status of Permanent Residence" ?

We are doing a CR-1 Visa through DCF.

ONE MORE QUESTION!!! On the checklist I have it says under Supporting Documentation "Marriage Certificate - Please provide a marriage certificate issued by a public authority to show that a public record exists of the marriage between you and your spouse. A copy of your marriage license or marriage certificate signed only by a minister or justice of the peace is not acceptable."

So does that mean my marriage license I got from the justice of the peace with the town clerks signature isn't sufficient?

The I-130 Requires a G-325A from beneficiary, and petitioner. Keep in mind you are filing the I-130 to the USCIS office located un the consulate, so it still requires the same things that it requires when filing the I-130 in the USA. You are filing the G-325A in conjunction with the I-130 Immigrant visa petition.

Later after the USCIS office in the consulate approves the I-130 then you will be providing DS-230 to the consulate to apply for the actual visa.

ONE MORE QUESTION!!! In most places the executed license is sent to the clerk's office, and you get a marriage CERTIFICATE from that office, proving that the marriage was recorded.

PLEASE fill in profile details, it helps answer questions knowing WHAT country in which the US consulate you will be dealing with.

So what would I put on the G-325A under "This form is being submitted in connection with an application for" - "Other" - DCF or CR-1 or would I tick "Status of Permanent Residence" ?
Other, I-130 Petition.

You will be filing an I-130 first, and two G-325A forms are attached to the I-130, one from petitioner (US Citizen) the other from Beneficiary.

A warning, A spousal visa results is a green-card, the green card REQUIRES a sponsor, the sponsor MUST provide an I-864, and I-864 REQUIRES US domicile, and past year IRS return. Many living overseas for a period may give up US domicile, so this can pose a problem, the petitioner/Spouse MUST sponsor the immigrant, and MUST provide the I-864 which can be a problem if US domicile is not maintained.

whats the difference between I-864 and I-864A?

I-864 is the AFFIDAVIT of SUPPORT, it is completed and provide by the sponsor.

I-864A is used in cases where a sponsor or joint sponsor needs to add the income from a family member living in the same household, the household member fills out the I-864A to add their income to that of the sponsor. I-864A cannot be used by it self, it is used in conjunction with an I-864.

Your US citizen spouse can only use an I-864, and if you need to use a joint sponsor that is in the USA, the joint sponsor also provides an I-864, and if the joint sponsor needs to add income of a family member living in the joint-sponsor's household that family member can provide an I-864A to add income to the joint-sponsor.

You only have to show your intent to domicile in the US, not that you are currently domiciled in the US. Also, keep in mind, residency and domicile are TWO different things! Just because you are residing in a foreign country, doesn't mean you don't have domicile in the US. In the case of DCF, you only need to submit a letter of explanation expressing your intent to return to the US and what steps you have taken to do so, i.e. job, driver license, bank accounts, etc.

G-325A comes with 4 copies, and if you read the instructions, you MUST fill out all 4 copies, exactly the same. If you use adobe with a .pdf that you can download from any embassy site, it automatically copies everything you type on the first page to the other 4. You need this form filled out for both the petitioner and the applicant.

Not for London -- they only want one copy (i.e. page 1) of the G-325A for both the petitioner and beneficiary. It says this very specifically on the London I-130 instructions.

You guys are getting confused. The G-325A is a four page form. The four pages do contain the same information EXCEPT...the first page is labeled page one and is for one entity, the second page is labeled page 2 and is for another entity.

Like a multi-part invoice, top is original, yellow copy to signer, pink copy for file. So if iinstructions say they want the G-325A form, they mean all four parts or pages of the form. Each is slightly different. Look at the actual document.

Not for London, elmcitymaven is right, only page 1 per person as per London US Embassy instructions, I guess each Embassy has their own little rules, who knows.

Abandoned application and OH moved to the UK.

April 2009 starting all over again DCF this time.

Marriage : 2007-08-03

I-130 NOA1 : 2009-05-06 (no receipt received this is the date the money was taken from credit card)

RFE: 2009-06-02. Credit card receipts and dreaded RFE's.

RFE replied to: 2009-06-04. Hoping they have everything they need

NOA2 approved: 2009-06-11.

NOA2 received: 2009-06-15.

Packet 3 received: 2009-06-17.

Packet 3 returned: 2009-06-17.

Medical booked for July 13th.

Medical done, passed pending xray and blood tests.

July 13th: Still waiting for interview date...phoned DOS and they said everything is in order and we're eligible for an interview and to be patient...back to waiting.

Called DOS again 17th July, they said we have an interview date whoop!!

Interview: July 29th (hubby's birthday) WOOHOO!! Visa approved

SMS message 31st July saying visa will be delivered on Monday.

August 1st: Visa here!!!! whoop whoop!

So much left to do...but the worst is over :)

September 14th: POE Chicago

Ok, now I'm confused. Both the American citizen and the beneficiary fill out the G-325 form 4 times a piece!? Why would the US citizen fill out a form that tells you to sign at the bottom and provide your alien registration number. And how would I go about getting that number for my husband?

12. One passport-type photo (see specification) of the petitioner. Write the full name on the back. Place in a plastic bag and label the bag "Photo of <Insert Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

13. G-325A (all four pages) filled out by the non-US Citzen spouse signed and dated

14. One passport-type photo (see specification) of the non-US Citzen spouse. Write the full name of the beneficiary on the back. Place in a plastic bag and label the bag "Photo of (insert name) ". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

15. Evidence of a bonafide marriage (see note below for what to include)

Yes both. They ask that both fill it out, they want 4 copies.

If your spouse does not have an alien registration number, put N/A in that field.
