Hello to all

I have a two part question I am asking on behalf of a friend and would like to thank you in advance for any advice you may have.

First off my friend filed a petition for a K1 fiance visa in late march. He received NOA1 and has been waiting for the IMBRA RFE.

He now (due to some very unfortunate circumstances) wishes to withdraw the application.

How does one go about withdrawing an application that has not yet been approved?

The second part of my question is this. The first application is the only one he has ever applied for. If he withdraws the application before it is approved and he were to meet someone and want to file another application for a K1 visa before two years had passed would he have to file a waiver or does that rule only apply when the application has been approved.

My reason for asking that is I am wanting to introduce him to someone and am wondering what he will be up against if they happen to hit it off.

Thank you again.

If you don't reply to the RFE within I believe they said 84 days your petition is considered abandoned. I don't know whether this would count against him but I am pretty sture that it will.. ..

Thanks vartan

My question more specifically is wether or not an application that is cancelled before it is approved counts as far as filing another petition within two years without having to file a waiver.
