You have been asking a LOT of questions, have you first :guides: ???

SSA requires.

Foreign BS + English translation for DOB

Passport for photo ID

I-94 card in passport to confirm legal presence.

K-1 visa to base SSN on.

K-1 can only get SSN within 75 days or so after entry to the USA, after that an they will need EAD or Green-card to get SSN.

Note: do not attempt to apply for SSN with in the first 2 weeks after entry to the USA, attempting to do so will run into a problem, it takes USCIS at least 2 weeks to update database used by SSA to confirm immigrations status.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

Check SS-5 application form from SSA website.

That contains all information you need to know.

www.ssa.gov/online/ss-5.pdf

According to SS-5 Page 3, forign nationals needs to bring foreign passport (valid one), and immigration document.

Probably in this case, you may wait for AOS and EAD.

In the past, EAD and valid passport was sufficient to get SSN, but nowadays it may vary from SSA employee to employee.

Keep in mind only the K-1 is allowed to get SSN K-2,3 and 4 need EAD to get SSN.

USCIS has instructed SSA to treat K-1 as a work auth visa for only ONE reason, to allow the K-1 to get SSN so that they wont have problems getting a marriage license. Some states REQUIRE SSN before they will issue a marriage license.

Hi Yu & Dan & Moonhunt, you two have been so helpful =)

I did read the guidelines on obtaining a SSN. I know what we need to bring, my concern is ... the second form of identification... since i'm sure the Social Security office would not accept a Korean Citizen ID... so they would probably be asking for another form of ID with a Photo ?

That was my biggest concern. Because Birth Certificates does not present a picture attached...

Anyhow, i think we will register for marriage certificate first, then send off out I485 +I765 + I131 to USCIS. Then lastly we will apply for the SSN.

Then we will take care of DMV .. etc ..

Sorry, asked so many questions, all the sudden I realized that ! OMG! He's coming soon! so much to prepare ...

You can use his Korean Passport.

Since Passport Identification page will have DOB, it should be enough.

Normally for LPR, it is simply foreign passport (and/or US Driver License) plus Green Card (I-551).

I think EAD will work fine instead of Green Card.

For K1 Visa, you can try to use K1 Visa for that purpose, but it may be different from SSA employee to employee to honor it or not.

K1 visa is 90 days validity, so if I were you, I will wait until EAD arrive.

It is fine to apply for SSN even on the second day when you land on US soil. I agree that SS dept takes sometimes to check the status of applicant but it doesn't take more than 4 weeks. I did the same thing and got ssn within 4 weeks. In normal cases if you apply for SSN. It takes 2 to 3 weeks. So what's a big deal if you apply right away when you arrive or after sometimes.

Think about this one moment...

Your fiance has his PASSPORT, a valid government issued ID from his country AND

His K-1 VISA a valid government issued ID fromthe United States, all in one handy container! They ARE two separate forms of ID

This is a common misconception. They K1 IS a separate and valid ID regardless of what an untrained SS clerk thinks. DO NOT be detrred in your mission by ignorance and made up rules (for some reason ignorant government employees seem compelled to make up new rules rather than ask questions when faced with something they are not trained in)

Go to SS, apply for you number with your passport and K1 in exactly the same name as on those documents. You will be able to get your number the NEXT business day, the card will come in 1-2 weeks. DO NOT leave until this is successful, continue to ask for a supervisor if necessary. Another thing is to print out the SS administrations own rules for SS cards (available on this site) it is often necessary to train them yourself.

Go to SS the day after he arrives, apply for the card before you unpack bags. You will NOT need it for AOS but you WILL need for many other things including bank accounts. Rules for SS cards are FEDERAL, exactly the same in all places, it is NOT determined by individual SS employees. You do not need to wait two weeks, the "SAVE" system which updates legal entries into the US is updated every night at all major POEs.

So then a K-1 visa holder who is now married, and has the EAD card (but not green card) can still get a SSN? We missed the deadline for the SSN when it got too close to Vika's K-1 expiration - even though we were married when she applied.

Yes. And now that she has a EAD in her married name they should give you no more "name change" problems.

FYI: We just applied for my fiance's SS# with no problems.

Today is 13 days after her arrival and she was in the system.

They did not question anything. They took the application paper and looked at her passport and visa and said she will have the card in 7-10 working days.

Anyone that gives you a hard time for SS# does not know the rules.

We applied again today, and Vika was still not verified in the system. The SS office worker said that it could take 2-3 weeks again, but the good news is that her work permit won't expire before the card is approved and issued.

EXACTLY! And she can CALL or go by the office Monday and receive her NUMBER. The card will usually come in about a week.

Brad, this just isn't right. Have you talked to a supervisor? The only problem I can see here is that since her I-94 is expired the EAD may not be in the system, that or someone needs to drag the clerk over the counter and choke them!
