Brother with resident card (issued when he was a baby) wants to come to US, he is 21 years old now

Hi all,

I hope somebody can guide me. My brother wants to come to USA, he has a green card, but it was issued when he was a baby (3 years old), his picture shows a baby.

He is 21 years old. Is it possible for him to come to US showing his green card? does he need a new one?

I am sure nothing has been done to try to maintain his residency. Establishing permanentl residency someplace else (which he has done) is de-facto abandonement. At a minimum a re-entry permit needs to be acquired because he has been gone for more than one year, the chances of which I am sure is slim to none.

I am sure nothing has been done to try to maintain his residency. Establishing permanentl residency someplace else (which he has done) is de-facto abandonement. At a minimum a re-entry permit needs to be acquired because he has been gone for more than one year, the chances of which I am sure is slim to none.

Nothing has been done. My father is a US citizen and me too. What do you recommend us to do?

Yes, it is our father. He became a citizen in 2000, my brother was 12 years old, he was in Mexico.

If your brother was a permanent resident of the United States at the time that your father became a citizen and was living with your father in the US at that time, then your brother became a citizen at the same time. It sounds like your brother has not lived with your father in the US since 2000. Is that correct? If it is, then I think you will have to start the process over, your father can petition for your brother, but if he is Mexican, the process will take many, many years.

It would be worth a consultation with an immigration counselor or lawyer, in case there is some law related to children that we don't know about.

If your brother meets the conditions, he IS a citizen. In order to obtain proof, your brother will need to file form N-600. The conditions are in the instructions for the N-600.
