Will remaining employed in the UK adversely affect my AOS?

Hi,

I attended my K-1 visa interview this morning and plan to move to the US in the coming weeks. Due to the nature of my job (I am a Management and IT Consultant), I can relocate to the US while remaining a UK employee while I apply for my EAD, and then transfer to our US offices once it has been granted. I have been told that this might adversely impact my Green Card / Alteration of Status (AoS) application later. Is this true, and if so, how will it impact the process?? I asked in the Embassy this morning, and the gentleman I spoke to said that it wouldn't. He said that my AoS application was based on where I was domiciled (i.e. in the US) and that they did not care where my pay check came from. Does anyone have any personal experience with this??

From the time you enter the USA until AOS is approved you are considered to be a NON-Resident you are a resident of the UK.. IF you continue working for your former employer, as in "Tele-Commute" you are not working in the USA, this the same thing as a business or visitor doing work for their home office by emails or remote from abroad.

I see no issue with this, a foreign employer employing a person holding foreign residency as in a UK employer, employing a UK resident does not need to comply to the I-9.

USCIS doesn't have anything to do with your overseas job. They are just concerned within. Your AOS would be fine. shooot the packet!

AOS Transferred to CSC.......................August 4th 2009

AP/EAD Approval Notice appeared....August 21st 2009

AP/EAD received in mails.................... 08/27/09, 08/31/09

AOS at CSC.............................................Pending
