I am a little confused about what needs to be submitted for the I-129F.

Do I submit the "Certificate of Finality" or the "Annulment Decree"?

10-27-2009 ---- Medical 11-11-2009 ---- PEPS for Annulment Issue 11-18-09 ----Received PEPS Result

12-04-2009 ---- Interview 12-12-2009 ---- Visa Received

12-18-2009 ---- Flight to US via PAL ...POE - LAX

03-02-2010 ---- SSN and State ID

02-09-2010 ---- Mailed AOS( 485, 864, 131, 765, 1145)

02-12-2010 ---- AOS Package Received by DHS-USCIS

02-18-2010 ---- E-Notification, SMS and NOA Hardcopy Received

03-15-2010 ---- Biometrics Appointment in Milwaukee, WI

04-09-2010 ---- Authorization for Parole/Travel Dox Received

04-16-2010 ---- EAD Card Received

05-12-2010 ---- Interview Schedule in Milwaukee..PASSED!!! Thank You Lord!

05-17-2010 ---- Welcome Notice arrived in mail

06-01-2010 ---- Received Instruction Permit Card from DMV

06-10-2010 ---- 2-yr. GC/PRC arrived today in the mail..SALAMAT PO LORD!

12-12-2010 ---- Got my DMV License

What comes first is the DECISION or DECREE of ANNULMENT

Once the DECISION or DECREE is not CONTESTED by the Prosecutor's office, a CERTIFICATE OF FINALITY is then issued by the court which issued the DECISION or DECREE

Hence:

A Decision or Decree is appealable which maybe reversed while a Certificate of Finality certifies that the DECISION has already been rendered and is now FINAL and EXECUTORY, meaning it can no longer be contested or can not be a subject to appeal.

August 16, 2010 - Petition received by USCIS Vermont Center

August 20, 2010 - NOA1 received

October 4, 2010 - Biometrics

January 3, 2011 - Permanent 10 yr. Green Card Received.

You need Annulment decree to attached in your I-129F.

In my case, our immigration lawyer asked my fiance to send them the following: The Decision of the Court (decree), The Order (second decision, since the Prosecutor filed for motion for reconsideration), and Certificate of Finality.

My petition was not submitted to USCIS until they got the Certificate of Finality which was issued 2 months after the second decision was made.

hi there jom..thanks for the reply

i wanna know if the Certificate of Finality can serve as a proof that my fiancee can revert back her maiden name even without the NSO annotated Marriage Contract yet on hand? she will just present the MC annotation during her interview because that will take her a month or two to get it from NSO manila unless she will personally follow up that..she got the finality only last friday but in the meantime, can it ( Cert. of Finality) support the filing of our K-1 visa? we are planning to do that this week... thanks and God speed

hi there lyn..im confused because accordingly a court decision is the same as the annulment decree..

so whats really that annulment decree u received since u already had the finality? was it from the court, civil registrar or NSO? and what does it say??i hope u dont mind...by the way my fiancee just got her finality....
