I hold a Permanent Resident Card, married to an American with an IR1 status. Wife and 3 kids in America all with American passports. Seperating from wife and basically living in England. When I went through LA last they wanted to take my card off me due to my pattern showing that I was not living in America and thus was "not entitled to the privilidge of a Green Card. Only thing that stopped them was when I informed them that one of my sons had just signed up to the Air Force.

Can I defer it for a year? Travel in and out on visa waiver? I just need some time to sort my life out.

Defer what exactly.

They would see your using the VWP, and probably give you the same line of not "living in America" with the greencard.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

i think there is some special form you need to fill out,,check out their website

I spent some time trying to find anything online about it and what the form is but have failed so far. Will try again.

Thanks

You cannot surrender the card for a year. If you surrender it, it is gone.

If you are going to be out of the United States for an extended period of time, you can apply for a rentry permit, using form I-131, the same form that is used for AP.
