hey everybody,

im writing this on behalf of a friend of mine. she is from russia and here as an au pair for about a year now. last week she married her boyfriend and now wants to adjust status.

can someone tell me which forms besides the I485 she has to file?

is it necessary for her to also file for ap and ead?

once she knows which forms to file she just hast to follow the instructions for each form in regards to the supporting documents and such correct?

Does she have any restrictions on her exsisting visa, like 2 year (out of country)?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

i did read the guides but the "adjusting from different visa types" doesnt provide too much info....

i dont know if she has any restrictionhs on her visa! are such mentioned on her visa?

As an au pair she would have J-1 visa. Have her look at her visa under "annotations". If it says that she has 2-year home residency requirement she will need to get a waiver from her country and DoS.

If she does not, follow the guide for adjsutment of status from work, travel, student visas.

@milimelo thanks for the info! ill let her look at that! if she has the 2 year HRR how does she waive that? at what time does she need to do that?

I finally found the guide for the I130 package :thumbs: didnt know that that one is the main form that needs to be submitted!
