My husband's last i-94 had the wrong expiration date in it, it said 2008 and not 2009 which is when his k-3 Visa expires, they also but 2008 in his passport. Now he needs to travel and we will be filing his AOS this week. His return date will be before his k-3 visa expires. I'm filing an AP as part of the i-485 but i'm not sure if they will give him one because the form says that K-3 Visa holders who have filed an i-485 and who return before their visa expiration date do not need an AP.

We have moved states and have lost the I-94 and have filed form I-102 to have it replaced.

I called USCIS and was told the date was a mistake as K-3 visa holders I-94s' expire when their visa expire. I was advised to have him but in the 485 ASAP.

but my question is should he travel or shouldn't he as his visa is still good?

as long as he re-enters before the K-3 expires he is OK to travel

I just don't know it seem risky. Can you try to wait for perm greencard before travel?

It seems like the K-3 is expired?

acording to the OP's timeline the K-3 expires on or about 7-23-09
