I can understand how this happened. Family tragedies are very emotional and sometimes it's hard to think and make sure you're doing everything right.

There's not much to say that others have already said about what to do. HCMC Consulate is the only hope, and if they understand, they'll do the right thing.

WOW. Did we screw up - BIG TIME. Please, no harassment...we already want to hang ourselves - just help, if possible!

Finally Phuong got the pink in HCMC. She got here to the U.S., and as soon as she touched down, her mom got deathly ill. In a panic, I sent her back to VN without checking the rules about that... now, they won't let her back to the U.S.

Someone tell me that our stupid not reading or thinking of rules can be fixed - or are we screwed?? I can't believe we did this... is there any way to explain we were just hyper, excited, confused and didn't realize she couldn't come right back to me? (we didn't marry yet - she was only in the states a few days!!!! and we are still within the 3 month period...HELP!!!!!!!!!!)

HELP. I think we may have ruined our lives.

The consulate in HCM is tough because the rate of visa fraud in Vietnam is very high. There have been at least three large scale federal immigration programs aimed at the Vietnamese people since 1975, which have resulted in millions of Viet Kieu living in the US. Like most east Asian cultures, family ties are strong with the Vietnamese, so the Viet Kieu in the US naturally want to be reunited with their family still living in Vietnam. Combine this with the fact that Vietnam is one of the poorest nations on earth, and you can see why the motive for visa fraud is so high. Because the consulate sees so much attempted fraud, they can be somewhat insensitive and harsh with applicants, and the burden of proving a relationship is sincere is a lot greater than it would be in a consulate in a western country.

yea, that is so true! of the 10 vietnamese people that i might know in the US, 7 of them want to bring their relatives into the US. whats the quickest and possible route?....marriage fraud!! :angry:

It can take an extended time for the death cert. to be processed and made available. More available to you would be the attending doctorz report and the gravity of momz situation.

I know several dozen Vietnamese people in the US. Some are friends, some are future family members, but most are just acquaintances. However, I think it's a pretty safe bet that ALL of them would like to see their families allowed to come to the US. I think all of them would also probably happily play matchmaker, and set up their family members with US citizens for marriage.

Now, this doesn't mean I think they would willingly engage in visa fraud. Remember that arranged marriage in Vietnam is still very common, and family members frequently perform as matchmakers to try to help members of their family into a better life. Most would never set up one of their own family members in a marriage if they thought their relative was going to be unhappy, or if they believed the marriage would ultimately end in divorce.

I'm not saying that Viet Kieu are not involved in setting up unwitting Americans with Vietnamese citizens for the purpose of visa fraud. I'm not even saying it isn't common, because I'm sure it is. I'm just saying that in a lot of these cases the Viet Kieu honestly believe they're arranging a legitimate marriage that will last. You can tell the ones who are sincere because they spend a long time getting to know the US citizen before even considering to introduce them to a girl or guy in Vietnam. After that, they get out of the way and let the relationship progress at it's own pace.

Okay, yeah it does sound bad. But realistically it could have been worse. Postive note, pick up your things and work with what you have. I strongly suggest you turn to your Congressman and plead your case like nothing before. Insha'allah everything will work out.

Regarding the death certificate:

Did I miss something? I didn't see anywhere where he said that the MIL actually died? Maybe she did (I hope not!) maybe she didn't. All I see is him saying she got deathly ill....does that mean she didn't recover?

Sorry if I just didn't read carefully enough.

If she did die: try as hard as you can to get a death certificate or at least some sort of notarized document saying that she died (if the cert will take too long).

If she didn't die: get papers from the doctors stating how serious the situation was to bring to the consulate.

To OP, if you really do need this forum's help, then you need to post update to your problem. It's like calling 911, shouting, "BIG EMERGENCY!!!! I NEED HELP!", and then when help arrives, you just sit there and not saying a word to the ET.

People will start thinking you have mental problems.

Just remember, life over there in VN is NOT real! Your money will be worth a LOT less once you get back over here. Back to reality, cowboy!
