Hi!

My husband and I are filing joint tax return. Although it is past the due date, I think it's good to do it. My question is:

Does his income need to be above the poverty rate BEFORE or AFTER expenses?

You should really read the guides and the instructions for filling out the I-751. There is no minimum income level for filing for removal of conditions (ROC).

mozplay is right please first put your timeline either in your signature or in your timeline section, it will help other fellow VJers to know about your situation better.

Secondly income level doesn't affect I-751 that's on for I-130 and AOS. For I-751 the more joint things you have with your spouse the better it is.

Remember not to file I-751 before your 90 day window e.g. GC expires 04-01-09 so 90 day window will be approx. 01-01-09, don't file before in this case 01-01-09 and don't after 04-01-09 as you will be deportable. If you wanna file bit late I would suggest at least file 50-60 days before your GC expires, Just in case if something goes wrong and they sent your application back, you can resend it and also you have get NOA (Notice of Action) and biometric before your GC expires.

Merlion, you can include your joint tax return as evidence of financial ties, between you and your husband. You do not need to submit an I-865 with this application or meet any poverty guidelines. Good luck with everything.
