Hello! I'm new to Visa Journey. My friend recommended this site and I found a lot of helpful things already. However, I wasn't able to find a specific case like mine.

I came to the US with a tourist visa in December 2007. I switched to a student visa in July 2008. I am a registered nurse and my employer filed the I-140 (Immigrant Petition for Alien Worker). It was approved in March 2009. I am planning to file the I-485 as soon as the retrogression for employment based petition (EB3) opens -- which is said to be in 5 years.

My boyfriend is in the US Army. He was stationed in Korea for 3 years. He would visit me in the Philippines and here in California whenever he was allowed to take a leave. Now he is assigned in Washington State. He wants to marry me and file a petition for me. We have been together for almost 5 years.

I have read through the necessary steps that we need to take like the filing of I-130 and I-485 so that I can get permanent residence in the US.

My concern is that the immigration might think that I am marrying for the wrong reasons. I do want to permanently reside here and I know that if my soon to be husband files a petition then the process will be quicker than getting permanent residence through employment. Do you think the immigration will consider my approved I-140 when processing the I-130 and I-485? Will they reject my soon to be husband's petition for me since my employer's petition was already approved?

I would appreciate any advice. Thank you so much!
