So my wife's EAD is over the 90 day waiting period so we called the USCIS.

After several hours of "we don't have your case on file" and "our computers are being slow, please hold" we finally concluded that they had no clue what was going on.

They finally gathered our information and sent this request to expedite our process but I really have a bad feeling about it.

they told us if we weren't contacted in 45 days we should call back.

I'm sorry but my wife has been sitting at home for long enough without a job and this is ridiculous. Does anybody have some sort of insight what could be happening?

Thanks,

Trevor

Is it safe to assume you're not able to track your case online via the USCIS website? (You should at least have NOA's for the AOS and EAD.)

(Not that that's a huge help at this point, but just from curiosity.)

You could also make an infopass appointment if you're feeling like you're case might be lost in the shuffle somewhere.

If it were me/us, I'd hang in there a couple more weeks and see what happens - they're usually pretty good about getting the EAD out since it is in everyone's benefit.

Yea I have the NOA for the EAD, the AOS, and the I-131. and no I can't find my case online or even if I call.

I'd like to wait a little longer but my wife is going to go crazy which makes my life SOO much easier. So I'd just like to see if anyone has some suggestions.

ask your congressman's office for help.

No doubt. They should at least get an answer about why your case can't be found or viewed online.

ask your congressman's office for help.

Yes. Call your local congressmen and ask if they have an immigration liaison on staff. If they don't, try the other one for your state. They have the power to require USCIS to tell them what's going on within 48 hours. That doesn't mean that you'll get an approval within 48 hours but you should at least see some action shortly afterwards. When mine went way over 90 days, we set my congressman's immigration superhero on USCIS. Within a week we had an RFE  and a couple of weeks after that, it was approved.

When you ask the m to make an inquiry of USCIS for you, make it easy for the aide to do that. Take or send copies of all correspondence with USCIS, and even email and a log (if you have it) of your calls to them. They really need the case number, etc. to speed things along, and your first and last few dates of contact are helpful.

thanks everyone. We actually did get a RFE just a few days after mailing and took care of it very quickly. I think I'm going to wait about a week more just in case the RFE pushed our date back, though I really don't think it should have. I'll start gathering information for my congressman though and I'll be sure to post to see if it works.

Thanks again.
