sorry in advance if this is in the wrong forum..

I need help! here's the short version:

My finace and I sent our application for a k1 three weeks ago. We are not married and are intending to do so in december of this year. He's active duty military and just found out he may be transfering to Japan late this year (maybe novemeber or december - not too sure yet). Obviously, if he goes to Japan I will want to go with him.

My question is how will this affect the visa situation? I can still go the US before he leaves and marry him to meet the k1 requirement but I am concerned about the AOS. Will it be possible to adjust my status, get my AP and then move to Japan? Will my being out of the country affect my AOS? I will be with my husband afterall.. but I am concerned I won't be approved for a green card if I only spend a month in the USA.

Please please offer suggestions. I am desperate and confused :help:

He may be able to expedite the petition.

USCIS Military

You may need a visa to go to Japan (being your from Canada).

If your married to a US Military member, they make allowances for that (AOS wise).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I think the best would be to come to US, file for the AOS (make sure to file for the Travel Document as well with AOS filing), and wait for your Travel Document to come in the mail. This way, you will have the freedom of being able to move about without being tied down here, and without haveing to wait for the green card....The Travel Document is great alternative. You waited this long to be with your husband, what would another month or half do while waiting for travel document..you'll just arrive later and meet up with your love....

01/16/10 - AP received

11/18/09 - AOS - NOA1

10/30/09 - Civil Marriage

10/24/09 - Entry/I-94 start

09/04/09 - K1 issued

07/15/09 - K1 - NOA2

02/24/09 - Filed I-129F

Hi there,

my other half is us military also. Here are few things you can do. He can call the military hotline for an expedite (sorry don;t have the number) and give them the info. Because he is being pcs'd, he will need the orders or state to them, that he will be obtaining them soon.

Sometimes they can expedite within a few months or less. For the AOS, the USCIS can be very accomodating to military spouses, so they would make an exception to the AOS. But I believe that you will still require a visa to enter Japan.

You should really tell your fiance to speak with his commander. He will beable to connect the 2 of you with folks who can answer alot of your questions as they affect military families specifically. Also, the military is well versed in soldiers marrying other nationalities, so don't be afraid to prod his command for help.
