AOS RFE - what happens now in terms of timing?

Hi Folks. My husband and I submitted his AOS along with EAD and AP documents. We got our NOA1 dated May 1 and a few weeks later received an RFE because we had not included a translation of his Mexican birth certificate. The RFE stated that my husband's EAD may be delayed and that a decision may not happen until 90 days after the receipt of the requested document translation.

We took care of the translation and sent it via overnight mail, which we could track. Someone at the USCIS signed for that mail on May 26. In the meantime, my husband has also had his biometrics appointment (May 28). I checked his case status online, however, and it says they're still awaiting information from the RFE they sent. The phone service, of course, says the same thing. Does anyone have an experience similar to this? Is there a way to figure out what they're doing with our case at this point? We have proof that someone signed for our document, but apparently it hasn't been entered into their system yet? The EAD receipt date is of particular concern, as my husband has a potential job pending... How do we get information about this case?

Their online service is unreliable so don't worry about that. They already received it and they're working on it. As long as it was confirmed through your postal office that the mail was received by them, then it was received. Just hang in there.

I am in the same situation, and have another job on the line that I don't want to lose as I already lost one...My status online says that processing has resumed though, although USPS is unable to provide me with a delivery confirmation :huh:

The status online says that they should reach a decision within 60 days of the receipt of my evidence. But I really need this EAD now :) is there anyone down here that has been in similar situation? If yes, how long will it take them to approve it :) I am very hopeful as people having filed early April like me are getting approved by big batches.

Your EAD may not be delayed that much since you responded to the I-485's RFE pretty quickly - I'd say your timeline's possible adjudication/approval dates are probably still pretty on-target. I'm always an optimist - you should assume the best too. (I know that's difficult to do when you have a clock ticking in your head...) :luv:

Thanks! I thought that I took a long time to respond. The fact is, I changed my address, but they still sent the RFE to my old address...so the RFE was sent to me on April 23rd, but reached me on May 15th, and it was in their hand on May 19th :( Worst, I got a RFE for a document that I had already submitted :(

We got an RFE for something we already submitted too...

me three and cost me another $300 to fix it

Thanks, ya'll. It's so helpful to hear from people going through the same nerve-wracking process! Patience may be a virtue, but it's not my best one. :-)

I also got the RFE on birth certificate. Took me three weeks to fix it and the process gets delayed by 3-4 weeks.

Keep checking the status at uscis site and one day you will find it there, hopefully sooner than later.

I would suggest you call and use option #3. Ask the operator that you want to speak to an immigration officer. You and your wife must be present in the room because they would ask to speak with the beneficiary. The officer will be able to tell you the real status of your RFE.

Samething happened to us. We sent back the RFE which was tracked and confirmed to have been received by USCIS. But anytime we call, no updates until we spoke with an officer. Few days later. the welcome to America letter and card production letter was in the mail. Goodluck.
