Timeline

Hi Everyone

My Hubby is coming to the States on Wednesday. We will be married two years in November of this year. My income is enough to support us until then so there is no real rush for him to get work. So when do you think he should file for AOS?

Also, is there a significant difference in fees if we file for EAD and AOS separately? I am reading the guides on here but I am confused about the difference in being married two years for AOS. :luv:

AOS has one fee... regardless if you file for EAD or not....

EAD before AOS has a fee of $340 (i think)

He might want to start a job, if you are working he'll get bored been at home by himself. Just my opinion unless you have a work from home job.

Application for Employment Auth. $340 when filed separately.

07/22/08 - Became US Citizen

08/02/08 - I-129F sent

08/13/08 - Case received by VSC

08/16/08 - NOA1

08/18/08 - Touched

12/18/08 - Touched again exactly 4 mos. after 1st touch!

12/18/08 - Noa2 @ 3PM-Gracias Dios Mio!

12/24/08 - NVC sent pckg. 3 to Embassy

01/02/09 - Pckg 3 rcvd. by Embassy

01/09/09 - Pckg 3 from Embassy received by beneficiary

02/09/09 - Medical exam

02/16/09 - Sent back checklist and docs required by embassy.

03/13/09 - We will fly to see Daddy Gary

03/16/09 - 1 PM Interview (Pray God he gets visa)

03/16/09 - 5PM INTERVIEW PASSED WOOHOO. Thank God.

03/25/09 - Visa on hand! he went to DHL office after phone call received.

04/18/09 - My Cuchi came, (NYC)a wonderful unbelievable moment!:)

04/20/09 - We applied for marriage licence. (Township Municipal Bldg Health Dept.)

04/23/09 - Licence on hand

04/29/09 - Applied for Social Security (He was in system!)

04/30/09 - Wedding day!!! Yeeebaa

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

I don´t need patience if I have love. Ah I que Viva mi Guayaquil Carajo!

Everyone above is correct - however, if you want to file for the EAD after the AOS filing, you can, and it won't cost you anything (as long as you have the NOA for the AOS).

But it makes sense to file with the AOS.

You should file for the AOS asap - to avoid any delays down the road.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

yes, but if they time it right they can avoid removal of conditions at a fee of $545.... they must pick the path that is most important to them

Hey Waheed, I am happy for you as you got your visa and most probably you would be here by now when i am writing u these lines. I first contacted you when I was also in AP, but got cleared within 3 weeks. Anyways...Welcome to US and i wish ya best of luck in your married life. If you guys need any help regarding how to apply for AOS. I would like to help you guys as much as I can...

AOS Transferred to CSC.......................August 4th 2009

AP/EAD Approval Notice appeared....August 21st 2009

AP/EAD received in mails.................... 08/27/09, 08/31/09

AOS at CSC.............................................Pending

Filing for EAD BEFORE AOS is common for K-3 holders, the resulting EAD is valid up to 2 years. This allows the K-3 to delay filing AOS until they are closer to 2 years of marriage, if AOS is approved after two years of marriage, this will avoid a 2 year conditional green-card. Just don't file AOS more than a year after visa medical, or elss you will end up having to do a FULL I-693 medical.

EAD costs LESS than filing to remove conditions later.
