augh I tried to edit the post of mine but I kept getting errors.. sooo here is my addition..

HAWAII is a USA state..

no Passport is required for travel...

but..

due to your status of not being citizen.. or PR you may be required to show your PASSPORT as identification to cross TSA security....

also .. as with any travel in any country.. a Person of Non Citizenship should carry passport no matter what country...

.. when i travel I never let my Passport off my person.. i keep in in a ziplock in my bra hahaha.. but.. for you being male.. hmmm .. ziplock to the inside of your shirt? ...

I would hate to have something happen.. .. even tho you are in USA.. you are still a visitor..

WAIT

If you came here on the VWP and met your wife here, got married and are having a baby...you should be applying for Adjustment of Status, not K1 (which is a fiance visa).

I would make sure that you have filed the correct paperwork before worrying about how to go on vacation....

Thanks Jen.. .. you beat me to the post.. hehe..

if you had no intention on coming here to Immigrate.. but instead arrived fell in love.. bla bla bla.. got married.. you can indeed file for AOS. Main thing for this is not to leave the country while the AOS is filed... . if you leave country. you will have to return to your home and wait it out without your honey.. however if you can prove your nonintent.. etc.. file AOS and remain here in USA while you adjust..

check out the forum of Adjustment of status.. for filing while here.. http://www.visajourney.com/forums/index.php?showforum=130 AOS for work tourist etc..

Thanks for the reply

Can i fly there with my irish driving licence then because i dont want to show my passport with the expired visa attatched?

I doubt it. If you are a US cititzen, your dl is a valid id, I'm willing to bet that you need a passport.
Wrong. Foreign-issued DL's are considered as valid ID due to their issuance by a government.

So any ID issued by a government is valid in the US? Now I can see how an Ireland license may be accepted, but how about one not in English? How about with Chinese characters? Korean? Hindu? And how would you check the validity? All that being said, they probably aren't going to check the status of his visa, just his identity.

Asside from the K1 issue, he is here from over staying his visa waiver program. If he is past his expiration date on the VWP he may need to leave first. Now he wants to take a mini vacation in Hawiia. Come on he is here illegally, he needs to go back to Ireland.

I think the red large letters are just to get his attention. Love can be blind, but he does need some direction on which visa to use, plus he has to get a grip on being here illegally. He has over stayed his VWP.

Hi guys.

i am an Irish national. i came to the USA on the vwp and met my girl here.

we fell in love and we are expecting a baby now. We are very much in love.

We got married recently and we sent off our forms to apply for the K1 visa ect.

As of yet we have not heard anything back.

We would like to go for a short break in Hawaii for a few days.

is hawaii airport like the other cities airports of america for entry ?

Or will i get in trouble ?

Is it better to stay putt

thanks for your input on this :innocent:

If possible, stay low.

For travel documents, only government issued passport is acceptable for inter-country travel.

Since this is the travel within U.S., you can use passport and/or driver license issued from US government agency.

Foreign driver license "may" not be honored since it is not valid outside of that country.

But since you came to U.S. as VWP participant, if US ICE officer or immigration officer found out, you can be kicked out right away.

VWP participant is not eligible for any lawful protection such as appealing.

No protection or extentions of the stay.

If you are spouse of US Citizen, you may apply for Adjustment of Status to LPR based on IR1/CR1/F2A status approval - F2A have limited quota -.

But even during those time, you can be kicked out since you don't have any right for appeal or legal protection as a part of VWP deal, and also it may initiate 3/10 year ban for coming to US depending on your out-of-status period.

So if you want advice, please stay low, and don't go near to anywhere US CIS/ICE or any lawful agent is hanging around.

Nowadays you never know.

Even you can be asked for your passport and immigration document when you get on board to ride bus.

I'm assuming the large letters were not for the original poster... it was to stop people repeating the same infomation (like I was about to do before the large red letters caught my attention)

If you came on the VWP you wouldn't have an expired visa in your passport. You might have an expired I94W.

If you have filed to adjust your status (and not the K1 you state you have filed for - a redundancy since you say you are married) you could always carry the I797 receipts for the I130 and I485 as proof of your 'status' in the US.
