Write Off Immigration Fees?

Sure you can, just own a business, and prove to the USCIS you cannot hire anyone like that in the USA, then you can write it all off, even the plane ticket and the attorney cost.

Can you write off your immigration processing fees? I filed an I129f and hopefully will be filing AOS this year. Can I write any of it off?

I studied this myself. "moving expense"? No. Actually I could not find a way.

Its not a moving expense? ;)

No. Because the move has to be within the USA and related to your job.

No. In that case the BUSINESS writes it off. IF the business is a sole proprietorship it would affect the final tax paid by the individual but waould also reduce gross income by a subtantial amount which is not desireable if filing for AOS using "income" from that business. Not to mention the difficulty in demonstrating someone petitioned months before on a family based visa was needed for a business in lieu of American workers.

I'm a tax accountant, I'm sorry to tell you that they are not. Adoption related expenses may qualify for Adoption Credit, but this is not applicable with an I129F petition.

Anytime one has to "reach" to get a tax deduction, it is not a good idea. Whether it be a home office credit, gambling losses, or being a home breeder of bull dogs with 10 kennels (a friend of mine got a home visit from IRS agents on this one--Yikes!)

Its just not worth sending up the red flags on the IRS computers.

Now that IRS is 34% down on tax revenues, they are extra hungry and mean, so trying to pull off highly questionable tax deductions like immigration expenses is quite foolish.

Liberace once tried to deduct his flamboyant costumes as a business expense. After a long IRS battle, he won.

For me, any battle with IRS is a loss. The stress and sleepless nights are not worth any deduction you might get.
