Hello,

My girlfriend's TN Visa was due to expire in late April. She, through an Attorney, filed for an extension and received a receipt of application. Her TN has yet to be approved. She has been offered another job and wants to take it but she will need a new TN, and need it quick. She plans to go back to Canada and re-enter through customs with: her new employment letter, Canadian Passport, Diploma, Occupational License, proof of temporary intentions (bank account in Canada, immediate family in Canada etc...). Her POE will be US Customs in Montreal. Because she has a TN application filed currently with another employer will she need a I-129 to change employers? Or, because she is interviewing at the POE for the TN, will the above documentation be enough?

You can have TN status for more than one qualifying position or employer at a time. In 2004 I changed jobs, and briefly held 2 TN's during my 2 week notice period. I would just turn in the exit document (I-94) for the old job the next time she leaves the country and re-enter on the new one for the new job. As long as she has no gaps in the authorized stays, and does not work without authorization for either employer she should be ok.
