Other acceptable proof to stay in the U.S. for 5 month periods during K3 Visa processing?

Timeline

I know that my future wife can stay in the U.S. for 5-6 month periods during her K3 visa processing as long as she provides proof of intent to return to Canada. Examples given include: lease agreements, letter from employer. Unfortunately, my fiancee lives with her parents, and is quitting her job right before we get married. Does anyone else know of any other proof she could provide for intent to return? We're currently in the K1 process, but if she doesn't get the visa by the wedding date, then we'll wed, then file for a K3. She plans on returning to Canada during Christmas and summer, until she gets the visa. Thank you for any help you can provide.

Hi transit and welcome to VJ and the Canada forum.

Hmm someone asked a similar question last week. I think the only suggestion was that she provide her immigration paperwork (ie: the K3 paperwork) - if she has no work ties and no lease I can't think of anything else that would really show proof of ties.

However, someone else might come along with some ideas.

If she has a bank account up there, she can bring some recent bank statements, showing that she still has an open account.

Dec.18/07 Moved to the US

Other small things like gym passes, phone bills (cell phones, even,) etc, etc. That's really all I can think of, perhaps some others will be on later who can think of more.

I do suggest reading flames9 <---(VJ member) signature in regards to what to say, and what to do when speaking with the customs and immigrations officers, the more prepared your fiance is when she speaks with customs, the better.

In December I tried to go to Chicago to be with my Fiance, (this was before we started the K1). I was living with my sister at the time as i had just moved provinces and sold my house and was unemployed. On my Birthday Dec 12 the POE refused my entry. They stated that i had no proof i would come back to Canada.

I was informed If i wanted entrance to the USA that i need a lease, utility bills in my name, proof of financial assets ( bank account etc), proof of school status letter from job etc.

I got a letter from my sister saying i lived with her and paid her XXX$ for rent, i brought utility bills for the 2nd phone like that was in my name, a letter from my bank with all my assets in savings etc. The appointment letter from the provincial government with my January appointment on it, and proof of acceptance for courses to be started in January as well.

I went back two days later to cross the border, and was refused entry again. This was not enough proof. I tried to speak to a supervisor about it and was told the supervisor did not want to see me and that the refusal was staying.

So again for the 2nd time i was brought to the back, photographed and fingerprinted, and given a letter to give to Canada customs stating i was refused entry and told to go home, all the while feeling like a criminal. :(

I cannot say to you or your fiance whether they will let her in, All i know is it is up to each individual officer and port to make the decision. One can accept you the other can deny you.

In my case i've tried two differnt POE's and both refused me.

In all honesty, I think they are looking at something that really compels you to return home. Utility bills on their own are not enough to show an intention to return. Its easy enough to cancel those while abroad. However couple those with an ongoing lease, mortgage payment, job, or schooling then it would seem as if you're definitely compelled to return to resume your life in Canada. Of course all of this is up to the discretion of the officer at the POE, so you can always try with what you have. Some are softer than others. Sounds like Kim got some real toughies.

Perhaps if you have children in Canada?

I would carry my traveler's health insurance for the time I was to be away, along with my return ticket. I was never questioned but I always had a stack of things to show connections back to Canada. I had a NEXUS pass also for the last year.
