Hi again,

My situation:

I'm a K-3 petitioner. My wife has her interview date in a little over 2 weeks in Bangkok. When she arrives to the U.S., I plan to file an Adjustment of Status. The fees are $325 application/$70 biometrics.

In late April, I received a packet from NVC requesting I pay: Affidavit of Support Fee Bill ($70) and Immigrant Visa Fee Bill ($380). I paid these.

Last week, I received the I-130 Instruction Packet from NVC with the forms: Affidavit of Supoort (I-864), DS-230 Part 1, Authorization for Release of Federal Tax Data.

Questions:

1) Since I'll be pursuing the AOS, do I submit all the forms and RFE that the I-130 NVC packet requested to my USCIS? If yes, where to? Chicago lockbox or my CA Service Center?

2) I guess I have to pony up for an additional fee ($325/$70) for AOS even though I've paid the $380/$70 fees already?

3) With my wife's K-3 visa, can she leave the U.S. anytime/however many times? What are the travel restrictions with the K-3?

1. If you will do the AOS once she get here then you don't need to send the packet to NVC. that is just if you pursue with the IR1/CR1 which needed to return to her country for the interview. You can just write a letter to the NVC saying that your wife will going to adjust her status in here.

Just a little confused about the I-130 packet as you mentioned, do you already have your I-130 filed? as I know you have to send this first before filing the I-129F (not sure!)

2. Yes you'll going to pay the $325 + $70 for AOS & Biometric fee.

3. Yes! k3 is 2 years multiple entry visa

05-07-2014---AOS show up payable and paid

05-09-2014---AOS Paid (shows processed 5/08/2014)

05-09-2014---Case Sent To US Embassy, Manila

05-11-2014---DS-260 Completed Online

05-12-2014---Case is READY!

06-25-2014---Medical Exam done in one day but ask to come back for Sputum test

07-07-2014---Interview Schedule @ 6:30AM Cancelled due to sputum test

07-08-2014---to 7-10-2014 (3 days Sputum Test) Negative result

09-09-2014---Sputum Final Result: (PASSED!!! 9-08-14 )

09-16-2014---Interview (221(g) for NBI a.k.a. name, I864 Orig. Signature & NSO verification)

09-25-2014---Documents sent via 2go

09-29-2014---221g documents delivered. & signed by L. Bernardino

09-30-2014---and 10-01-2014,Touched but still on AP

10-07-2014---Email sent to USEM

10-15-2014---Called USEM

10-16-2014---Sent Fax to USEM of approved expedited letter from U.S. Embassy General

10-21-2014---Touched but still on AP

10-22-2014---Visa Issued :joy:
