Got REF from CSC - how to answer?

My fiance got RFE from CSC today.

He got a form with 2 pages. I am sure about the question #1 ("did you met your fiancé(e) or spouse through the services of an International marriage broker?") our answer is "NO". but he is afraid i am wrong.

I sent an email to www.incredidate.com (the site we sent our first message) asking them if they are related to international marriage broker. This is their answer:

"Incredidate is not an International Marraige Broker.

Thank you for your updates.

Have an Incredible Day!

www.Incredidate.com

We want to hear from you. Please send us your comments and suggestions"

I agree with this.

This site hosts profiles and we can send and receive messages (as any other site they charge you to read any message - if one pay, the other one doesn't need to pay).

when he filled the I-129F he mentioned we met at first on the site: www.incredidate.com.

So, do you guys think i am right? Should he answer "NO" to this question?

My advice would be to not simply take their word for it. This is how the law reads.

(4) INTERNATIONAL MARRIAGE BROKER.—(A) IN GENERAL.—The term ‘‘international marriage broker’’ means a corporation, partnership, business, indi-vidual, or other legal entity, whether or not organized under any law of the United States, that charges fees for providing dating, matrimonial, matchmaking services, or social referrals between United States citizens or nationals or aliens lawfully admitted to the United States as permanent residents and foreign national clients by providing personal contact information or otherwise facili-tating communication between individuals.

(B) EXCEPTIONS.—Such term does not include—

(i) a traditional matchmaking organization of a cultural or religious nature that operates on a nonprofit basis and otherwise operates in compliance with the laws of the countries in which it operates, including the laws of the United States; or

(ii) an entity that provides dating services if its principal business is not to provide international dating services between United States citizens or United States residents and foreign nationals and it charges comparable rates and offers comparable services to all individuals it serves regardless of the individual’s gender or country of citizenship.

All that is necessary for the triumph of evil is that good men do nothing.

I think you really need to read the paragraph defining International marriage broker on the RFE. It does not list the exceptions. You might want to answer yes, and then give the information on the company. It is going to look real suspicious if you answered question 18 on the 129F that you met thru a company that provides a dating service and then you say no on the RFE. Your decision but by answering no, you might be opening yourself up for more problems. It is up to the USCIS to decide whether the company you went thru is an international marriage broker or not

I agree with the above 2 posts. Any service (I repeat any service) might be considered a marriage broker for the new law coverage (I am sure even match.com) so you have to say yes and describe the details. Just because its a dating site doesn´t exclude it (the site I used was also just a dating site but given the new law, I would describe it as under the marriage broker act. I just paid a flat fee to get the email address nothing more.) Good Luck

Just a thought on this subject, I feel the US government is demanding the marriage broker to comply with the new laws of US even though most of them are not in the US and do not have to comply with US laws. I feel the marriage brokers out of the US will not comply with the new laws and this will prevent many K1 petitions from being approved. I do not see any other reason for this question on the form. Because the form still ask the same question about your criminal history. And if you are honest and fill out the form correct the fiancée will see this without have the marriage broker send the information to them. It will be on the form alone with the attachment that states you criminal history. I hope I am wrong about this for the sake of all who have met though a marriage broker.

The US should focus more on the illegal entry then trying to prevent law abiding citizens from getting married to the ones they love

I am in a similar situation and have decided to answer no. I met my fiance through a site called singlec.com. It meets the exceptions that are identified in IMBRA. Its primary business is not to provide international dating rather it has a large section for USC to meet USC and a smaller section to meet non USC. It also charges the same rate for every person regardless of country the person is in. Eventhough the exceptions are not listed on the RFE they do exist and exclude those sites that meet the criteria. If your "dating site" meets those expections than I see no reason to answer yes. I have been considering attaching an explanation that my site meets those exceptions, you may want to do the same.

Shimmy, I think our friends above are right.

My friend sent an email to a famous lawyer and he answered that immigtation will probably consider those sites "sell" communication between men and women for potential marriage. he said she should answer YES.

Anyway i sent an email to CSC and i hope they answer me soon.

Latest steps:

10/26/2006- Consulate receives case (seriously, one month to receive the case?? BS!), and packet 3 that I sent even before they had received the case.

01/02/2007- Interview!!!!!!!!!!!!! Got a 221(g)

01/23/2007- Second Interview. VISA granted!!!

01/29/2007- VISA arrived.... no envelope though. I'm gonna contact them and see what happened this time!

01/31/2007- I'll have to send them one last financial support evidence.

02/01/2007- Evidence sent

02/02/2007- Evidence received by Consulate

02/06/2007- Consulate sends envelope!

02/07/2007- Envelope received!!!

02/10/2007- Flew to the USA!!!!!!

04/17/2007- Wedding day!!!

although i still not get my RFE, but i want to know how to answer this question too. I knew my bf on a webpage, www. asianeuro.com. He need to pay 25$ a month to contact others. How i answer? Maybe i should answer yes, right?
