My wife and son came to the U.S. April 2008 on K-1, K-2 visas shortly after we were married. We filed for AOS in May of 2008, and had our interview 9 months later in January 2009. Our interview went fine, and the officer said we would be approved but we needed to provide them with I-693 supplemental, and gave us 30 days to do so. We sent the I-693 with in the 30 days and thought everything would be ok. Now 4 months later we have not received anything so i called USICS to report the case was outside its processing time. Today I received and email stating....We are actively processing this case. However, we have to perform additional review on this case and this has caused a longer processing time. . They also stated this could take an additional 6 months. I guess this would not really be a problem but my wife and son's EAD and Advanced Parole documents expire in July, and to top it off the state sent my wife a letter saying if she does not provide something that shows she is still here legally they will suspend her drivers license in June. Well we are running out of any documents that says they are here legally. So what do we do????

Any one with any advice or knowledge your comments would be greatly appreciated.

You can renew the ead/ap as required.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

The renewed EAD will be proof for the Driver's License as well.

Correct, this is NO Charge, simply attach a copy of I-485 NOA1 letter to base these things on pending AOS.

Is now a US Citizen immigration completed Jan 12, 2012.

Yeap, renew the EAD, and do it asap so that she has it before the other expires.

Your I-797C from the AOS and the email from the USCIS shows she is here legally and her case is being processed. Some states (mine, for one) require that the person show they are here legally for a minimum period for issuance of a drivers license. You can file for a renewal of the EAD and AP and also send them copies of the email and I-797C
