Hi Everyone,

Just wanted to know if anyone or their spouse have gone in for their interview and has had prior refusal at a US border crossing? I am wondering if the Immigration guards are really pissy about issues like this if it was an honest mistake, but they still refused entry.

Has anyone or their spouse had this happen?

What did they say to you? Did they refuse the visa? Did they grant the visa? Was the interview hostile?

Unless there was some sort of ban involved at the attempt of the border crossing, I doubt it will be an issue at the interview.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I just wanted to make sure. They made a big deal of it last year when they turned him away but they didn't ban him for any amount of time.

no ban then you are fine, just be honest on the forms when asked....

What country is your spouse from? Why was he denied entry?

Most of the time it won't matter at all, unless you lie for some reason. Never lie on the USCIS forms, and never lie to US CBP. The IO will ask him about it at the interview, but as others have mentioned, unless he was officially banned, it should have no negative result on his visa application.

My husband is from Canada. My parents are building a new house and last year the started the construction. We didn't know that even if he wasn't getting paid for this help on the house, that it was still considered working in the states. They basically told him that he wasn't aloud to do this and said that we didn't have enough ties back to canada and to come back when he had more info. He came back again a couple of times and they said the same thing about ties back to canada, until the last time he tired to cross for just a weekend. They said that since there was no he could prove that he wouldn't be touching the house and since the house wasn't complete that our options were:

He never cross again

He wait until the house was done and then try crossing, but since he had been refused he would have to show alot of documentation.

We file for the K-3 visa

Needless to say the first two options weren't great sounding. So we opted for the K3 and filed paperwork about a month after his last atemped crossing.

They never ban him from trying to cross again, in fact, they told us the last time he tired to cross that they saw that we were trying to meet the standards that they were excepting and so they weren't going to do such a thing.

How will the IO respond to this information? If my parents house is still under construction will they give him the visa? Or will they again say,"you can't prove that you won't touch the house while under construction" and therefore won't issue the visa?

I am not sure what to do. My lawyer said that we shouldn't worry about it, but I am concerned. His interview is June 4th,2009. Time is coming to a close

His interview should not be a problem. Quite a lot of Canadians are denied entry every day due to insufficient ties to Canada. Just make sure he puts it on the DS forms that he was denied entry, and that he's honest about it. They will ask him about it most definitely, even if he doesn't put it on the forms, they know it happened!

No worries at all. I myself was denied entry for work reasons as well, and got my K3 no problem.
