they have no idea how it works... it cannot get into the consulate system without going through the "gatekeepers" doorway... the gatekeeper is none other than NVC

YMMV

Let me help. STOP calling USCIS! It is called the misinformation line.

When the USCIS completes a petition they send to the Department of State, it is out of their handsa nd they have NO SAY in where it goes or how it gets there. For them to give you ANY answer can be nothing more than speculation, you are asking the wrong people. Like most government employees, they do not say "I don't know, we don't handle that" instead they give a false answer and you go away. Mission accomplished.

ALL approved petitions go to the NVC, no exceptions. It is the path the Department of State has established for processing petitions into visas.

Agreed. But calling USCIS will rarely, if ever, result in good information. They WILL tell you something. The something is designed to prevent you from calling again. They DO NOT do business by telephone. Then you will come to this site and we will tell you it is wrong and you will call them again and repeat this until you are not only frustrated...but your blood pressure will pop the eyeballs out of your head.

FWIW the CRIS system lists our case as "pending". My wife has been here 9 months. It is bubblegum they give you to chew on. It means nothing. One day, you will open your mailbox and the approval notice will be there. Until then, prepare all your interview documents, translations etc.

Think of it this way....send me a letter. You address the letter to me, directly. If someones asks, you say "Yes, I sent Gary a letter". But it must go through my local post office. BUT, you say, "I didn't send it to the post office, I sent it to Gary." True, but you gave it to the POST OFFICE and now they will do what they want with it before it gets delivered to me. You, in fact, cannot say where exactly it will go until it gets here. Hence the old saying..."the check is in the mail"

Dragon-Fish,

When i received my NOA 2 it stated that your petition is now forwarded to the listed consulate & when I called USCIS they also told me that your file was going to the embassy . NopE! They are totally wrong. k1 visa DOES go through the national visa center, although its not as closely looked at as CR1's but it basically transfers from the USCIS to the NVC and then NVC issues a local embassy case #. Then your case is then forwarded by DHL to your local embassy, In your case, I believe its the AIT.

Anyhow, i know how difficult it is with the waiting process. The true story is there is nothing you can do before the petition hits the 6 month mark.

Wish you the best =)

I think they did know what they were talking about, they just answered the wrong question. They clearly said the documents go to the State [Department], which is correct (the NVC is part of the State Dept.). I suspect they thought you asked about the NBC - one letter different and your petition goes nowhere near it.

The fact that first-line people at the Misinformation Line rarely, if ever, make the effort to ensure they've fully understood what they're being asked is another very good reason not to waste your time with them. Just search/ask VJ instead, you'll get a better answer and without all that tedious mucking about in their phone menu system as a bonus :)
