I-134 question

Hi all,

quick question. over two years ago I was engaged and brought someone over via a K1 visa and unfortunately she ended up going back home before the 3 month periond was over due to homesickness etc....

my question being do I need to state that I have sponsered someone before if it has been over two years?

before I submitted my I-129F I called and they said I didnt need to disclose the prior K1 visa since it was over the two year period.

just want to make sure I do everything right so as not to lengthen an already painfully long process.

Since the deal wasn't completed - you are not sponsoring anyone right now.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

but the form says have you ever previously submitted... no qualifying language about "within the last two years" or "still in effect."

Yes, that is true, I was answering for question 8. on the form I-134.

I should of been more clear.

But that is correct, you would answer question 9 and 10 with the beneficiary's info.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

YES. You must list her but can note that she has left the country and is no longer "covered" by the affidavit. The question asks simply

"I have previously submitted affidavits of support for...."

Same with the question about petitions, you have to answer it truthfully, and of course I am sure you have told your current fiancee this because other wise she will find out from the CO at the interview or from reading the I-134a.

yes, she knows that I had submitted one in the past.

even in my cover letter for the I-129F I stated my previous application. I want to be honest and up front to avoid any complications.

they said I didnt need to appy for a waiver since my previous application was submitted over 2 years ago.

IMBRA waiver is something completely different... this however does NOT change how you prepare and answer the I-134

Yes ! You definitely have to answer YES! I petitions for an AOS for an X back in 2001.... and I still listed everything on the I134.

You should be state everything ...

Timeline:

2/18/2009: Mailed I-129F Form

2/20/2009: NOA 1 Receipt Date

3/20/2009: NOA 2 Notice Approval Date

05/28/2009: Interview APPROVED

7/22/2009 --POE (LAX)-- We are together forever <3

AOS Journey Begins Here ^------^

7/28/2009 -- Applied for SSN & Registered for Marriage License

8/3/2009 -- Civil Ceremony

8/5/2009 -- Received Marriage Certificate via Express Mail. Pass DMV Written Exam & Received Permit

08/11/2009-- Mailed AOS to Chicago, IL

08/17/2009 -- Check clears $1010 USCIS

8/20/2009- Touched ^---^

8/21/2009-- NOA 1 for I-485 and I-765 Hard Copy

08/29/2009-- Received Biometrics Appointment Letter in the mail, dated 08/26

09/03/2009 -- Early Walk In Biometrics Appt (Original Date 09/23)

09/04/2009 -- Touched ^---^

09/29/2009 -- EAD Card Production

10/07/2009 -- EAD Card Received

10/16/2009 AOS I-485 Interview in Los Angeles(APPROVED)

10/28/2009 -- GC in HAND <3
