SOMERSET COUNTY -- A quadriplegic who is physically unable to hold a gun or pull a trigger has filed suit against a town and its police chief, contending a decision to deny him a firearms purchaser ID card amounts to discrimination.

James Cap, a 46-year-old Manville resident who suffered a devastating spinal cord injury during a high school football game three decades ago, argues he can safely handle a gun with assistance.

A friend could place the weapon on a special wheelchair mount, he contends, and a mechanical device would allow him to aim and fire with breaths through a tube.

Only with the identification card -- a requirement for the purchase of any gun in New Jersey -- can Cap resume his beloved sport of hunting, he said through his lawyer, Edward Kopelson.

Borough attorney Francis Linnus said Peltack denied Cap's permit for safety reasons. The lawsuit "will be vigorously defended," Linnus said.

Under New Jersey law, a police chief may not give a firearms ID card to anyone with a physical defect or disease that makes it unsafe for the person to handle guns.

Cap, who has a valid hunting license, wants to hunt deer and small game, Kopelson said. He had wanted to go with his father, who died while the application was pending.

He could still go with childhood friend Bill Mendicino, who now lives in Kingwood and hunts in his own backyard. Whenever he visits Cap, he said, he brings deer meat.

"We sit and talk about hunting and the deer," Mendicino said. "You can see it in his eyes. He misses it."

bleh. i thought it was to off himself... but it's to go off wildlife eh??? f-him.

You don't care for the Second Amendment at all, do you?

His reaction time is delayed and will skew his aim. His friend cannot aim for him.

There's nothing in the text of the Second Amendment that makes the right to bear arms conditional on having good aim.

The second amendment, is about the only right that people refuse to update or interpret to reflect modern society.

I thought the story was funny because this is a pathetic test case for gun rights.

But for Dale Hagberg, a quadriplegic in Ligonier, Ind., Live-Shot is the only way he can hunt after being paralyzed in a diving accident almost 18 years ago. The 38-year-old was an avid bear and deer hunter in his teens, but now is dependent on a ventilator and unable to sit up in a wheelchair for more than a few hours at a time once a week. He has used Lockwood's site about a dozen times to target shoot and four times to hunt but has yet to bag anything. He uses his mouth to manipulate a joystick that moves a remote camera to zoom in and out of the target area on the ranch in Texas and to aim.

Liveshot is since defunct, and I believe that many states have since passed laws banning Internet hunting. Neat concept though. I remember seeing this on the news a few years ago and thinking "they have GOT to be kidding!!!!"

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
