I think that it was an impartial and nice message and I think you are right about what you said.

I already sent them a new I 765, a copy the NOA from the I-485 and copies of my passport and birth certificate and the EAD with a letter explaining the error.Hopefully they will send me a new one soon since it was their error.

I just wanted to say what I did if someone else has the same problem (hopefully nobody will have it).I don't know if it's the right thing to do but that's what I understood from that lady on the phone. If I will not hear from them soon probably I'll do the info pass as suggested.

your welcome, it's 50 % why we are here anyhow . I have been doing exactly the same in my own thread and hopefully it will help those a few steps behind in the same situation. That would make the whole being guinepig thing seem worth it.

Good Luck Marry! You never know with USCIS but that sounds like you covered all the bases.

After my K-1 I never received my original NOA1. Everyone kept telling me that I would have to pay $340 for a replacement. Well after the 30 days I called again I got some guy on the line from Vermont and he simply said he would send me another. It arrived just in time for me to send it with my AOS. So they lost my NOA1 but they did come through in the end.

off topic but you mention needing a missing noa1 from k1 for aos? We don't need the no1 for aos but we need the noa2, and i am wondering if thats what you mean because we are having the same problem but they forgot to update us online and everything. :unsure: I have till sept 9th (my aos interview) to cover my bases and try and either fix it or have a battle plan ready as we still have not got the noa2 copy or update on line :crying:

though fingers crossed our latest attempt might yield something by Tuesday :thumbs: its just interesting that people with the same problem get different experiences when trying to fix it . those people (uscis) perplex me they really do! :bonk:

Hannah+Vito...Yes I meant NOA2. Duh, I still can't keep it all straight. Who knows what really happened. My K-1 was approved on a Sunday, March 1st. I received the email notice first thing on Monday the 2nd. I was in Nicaragua at the time so I was unable to keep track of the paperwork arriving in the mail back home. Once I got to the states I realized that the NOA2 still had not come. I called USCIS and they gave me the standard wait the full 30 days line. Once I was preparing to file for AOS I begun to stress about the NOA2 again. This time I called and selected the option that stated that USCIS had made a mistake with my paperwork. The man that answered the call stated that I had reached the Vermont center. I told him that I never received my NOA2 and that I was approved on a Sunday, which I thought was strange. He told me that they have contractors that work on the weekends. It sounded like he was looking up my case and then he said 'OK we will send you another one right away'. I didn't ask any questions and said Thank You!

I just thought I'd join this thread since we filed for AOS (along with EAD and AP) on June 24, 2009 - better late than never! My husband had his biometrics appointment on July 21.

As of now, we are just waiting and, according to our online case portfolio, everything is still sitting at the National Benefits Center in Missouri. This is normal, right?

No email from CRIS yet, nor via anything post, except for 2 online "touches" on July 22.... :clock:

Hope everyone is doing well and that all this anticipation will come to close soon. Congratulations to everyone who's been approved and are one step closer on their journey!

Koakland - We're supposed to bring the originals of all docs that we filed with the application. So yes, that would include the marriage and birth certificates and anything else we sent copies of. I'm also planning to bring another full set of photocopies in case they want to retain any of them for their files.

I don't think that I was clear. We are required to bring originals of the BC and MC to the interview but we submitted certified copies because there are no originals. I think most people submit that - a certified copy of the MC and BC from the issuing authority (the city or county that you were born in). For some people, the BC and the MC has the date issued on the MC/BC. Can this have any date on it or must it be within 3 months of the interview?

Hmm, I had not heard of a 3-month rule before - where did you get that info? We sent in the application packet a copy of the marriage certificate (which states at the bottom corner that it is certified as of late February 2009) and the USC's birth certificate (certified all the way back in 1993). We will bring these originals to the interview. We were not planning on obtaining anything more recent. I did not receive an RFE when I initially sent them these docs, so hopefully they'll do for the interview as well. (A week from today!)
