My case has been received by my spouse's Embassy from NVC. I have yet to complete an Affidavit of Support for I currently reside in my spouse's country. Currently, I'm on a leave of absence from my work in the states that has allowed me to live in her country for nearly three months. If I choose to stay longer I loose my job in the states. Is there a time limit for submitting an Affidavit of Support? Can I continue this process in 6 months after returning to the states and starting anew? I know of the Direct Consular Filing process, but I'm unsure of the qualifications. Besides, we are this far in the process but are not ready to leave my new extended family.... yet

They will need the affidavit when they do the interview. Usually they request it prior to the interview, with the info needed to be sent to them.

Perhaps you should aquire a co-sponsor to help you?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

The approval of your petition is valid for four months but Consular officers can extend it in increments of 4 months either routinely or at your request. The affidavit of support is needed for the interview. If you don't have a co-sponsor available, time to take care of the practical matters involved with supporting a spouse.

Since we dealt with an immigration attorney, for the AOS, everything was sent in at the same time, I-130's, I-485's, G-325A's, I-693's, I-765's, and that lovely I-864, if your immigrant spouse has a couple of bucks or even a kid, they can do an I-864A to give the USCIS more security in their decision. Also that whole stack of evidence when with the package including all translations. Whether this expedites the application or not, hard for me to say, we got the NOA within two weeks that meant they were legal to stay here and the EAD's in about three months and the conditionals in six months. Maybe an entire complete package is the way to go, that way, they have everything they need to make a decision.

You are in Ukraine and you approved petition is in Kiev, yes? You must apply for the visa within four months of petition approval, or get an extension. You must submit an affidavit with the visa application at the interview. After the visa is issued she has 6 months to enter the USA. I would say, since you have a job, do the visa application NOW and submit the affidavit stating your current position with an employment letter and something documenting the leave of absence. You can claim your usual income as "annual income". Then you have up to 6 months to come to the USA.

I am not sure of your line of work, but if you have a job I would suggest trying to keep it, they are getting scarcer every day and at any rate, when you arrive she will have to adjust status and you have to submit another affidavit of support.

For a DCF I beleive you must be in the country for 6 months before filing. You will still need to show evidence of support. DCF is best for people who live or work in the country for other reasons and will be there for some time...military personell for example, or workers assigned overseas for some time. They will be there long enough AND have means of support.

Currently Kiev is running 5 days or less on interviews. If all your documents are ready I am quite sure you could call the consulate Monday and get an appointment for next week! They are not scheduling anything beyond June 19 at this point. They are waiting for the available appointments to fill up. On Tuesday of this week they had K-1 appointments available for Wednesday, literally, next day!
