Hello

I have 3 questions, 2 about G325 A and 1 about mailing I-130.

G325 A (APPLICANT'S RESIDENCE)

The form asks for residence and employment information for the last 5 years. To clarify, my husband was in US Army from 2001 to Aug 2005 and then went to India for 5 months in 2006. Do I have to mention the 5 month period in India? I dont recall but I read somewhere that unless you live in a foreign country for 6 months, it is not considered as "living" there and your permanent residence is still considered as the country you are a citizen of. Is this true? Also, since he joined the army in 2001, do I write down his army address from 2001 or from 2004 (considering they only ask for 5 years)?

G325 A (EMPLOYMENT)

After my husband left the army, he didnt work for almost a year(Aug 2005-May 2006). Since it is part of the last 5 years, do I mention this time period and say "Unemployed" OR do I leave a gap. So the form will will have May 2001- Aug 2005 (US Army) and then May 2006- Present? Also same as residence question, do I enter May 2001 or May 2004?

MAILING I-130

This might come across as a silly question. My husband will send out the paperwork via UPS. Should he send it to USCIS Atten FBAS 131 South Dearborn 3rd floor, Chicago IL 60603-5517 OR to USCIS P.O Box 804625 Chicago IL 60680 -4107?

Hopefully these questions dont come across as dumb :-(, I am still trying to understand how this whole process works.

Thanks

I am not sure of your first answer, did he go to work there or just travelling, if its travelling then no he doesn't need to include that since residency is claimed after 6 months of stay at a place but if it was regarding employment, he will have to list that along with all the employments in the past 5 years.

But for the 2nd one, yes you have to mention the Unemployment period while filling G-325a.

This is the address to send i-130 package depending upon your state

Thanks trinket for such a quick response.

He was travelling, so I guess I dont have to mention that. I'll modify the G325A for employment. Do we need to explain any unemployment period?

As for mailing, I was confused because there seemed to be a different address if you are sending in package via courier/express delivery, so I wasnt sure if we should use the address mentioned for state he resides in (IA) OR the special address for courier. I still dont understand why they have a special address. Is it something I missed?

Also can anyone confirm if employment and residence has to be for 5 years specifically? For instance my husband was in the army from 2001 to 2005. So when I specify his address, do I say 2004-2005 OR 2001-2005?

Leave no gaps - they will ask about them.

Last 5 years is from the date you fill out the 325. (like from today - backwards 5 years)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

I thought it only called for places you lived at for more than 12 months. Since I only stayed for 10 months and was an exchange student I figured they dont need that. But then, I will write that down. Thanks!

It's going to be critical that you read carefully and interpret literally. Context matters. Us the instant literal context without reading extra things in that aren't there.
