Hi everyone,

It's finally time for me to apply for removal of conditional status. Here's my problem. 90 days before my greencard expires is May 25. I was supposed to apply already but given my current situation, I decided not to just yet.

The problem is, we're moving soon...around July 1. If I apply now, I'd have to:

1) File for change of address online

2) Call USCIS since I have a pending application when I move

3) Deal with the post office

4) Risk not receiving notices from USCIS

(I know how it is--for some reason, I always happen to have to move when I have a case pending. It happened when I was adjusting my status. What a nightmare. ).

But still, needless to say, it all worked out in the end and I received my greencard. Applying early has the benefits of possibly getting the GC quicker (by almost a month).

If I do wait until after I move (after July 1), all I would need to do is:

1) File for change of address online

2) Apply for removal of conditional status

3) Wait

The latter seems simpler...but what if this causes my greencard to be super-delayed? What if it arrived after my current GC expires?

What do you think should I do? Thanks for all your help

most likely you would get your new green card after your old green card expired anyways , no matter which way you do it..

very few people get the new card before the old one expires .. it can take a few months and even up to a year or more to get the new card...

but you should be getting a NOA that will act as your green card until you get the new card...

If i read your post correct your GC was going to expire on May 25th 2009. Your 90 day window started sometime in February around 24 or 25th.

Today is May 28th and your GC is expired and you haven't applied for I-751, you are out of stay now and might be put into deportation proceedings.

Everyone has to move. Regarding your situation what you should have done was,

You should have applied for I-751 soon after your 90 day window opened then you should have

Applied AR-11 online and printed the confirmation page, made a copy of it have your USC filed I-865 and attached the confirmation page and send it tot he address for I-865 USC change of address.

Changed your address with USPS so that your mails were forwarded to new address.

I would advice contact a good immigration lawyer ASAP.

If i read your post correct your GC was going to expire on May 25th 2009. Your 90 day window started sometime in February around 24 or 25th.

Today is May 28th and your GC is expired and you haven't applied for I-751, you are out of stay now and might be put into deportation proceedings.

I agree! That's a great idea.

I think the OP could also send in the change of address form before moving, once the new address is known. If the move is 100% definite (lease signed or whatever), send the I-751 packet a few days or so before the move - just put the new address on all of the paperwork. Gets things processing a little sooner, plus eliminates the possibility of losing the paperwork during the move. If the copies are misplaced, not as much of a problem - they can be unpacked later.

I agree! That's a great idea.

If you have family or someone where you are moving, you can also have things sent there, just fill it out that way on the paperwork. We had the same dilemma, and we moved around the end of the 90 day window so we had everything sent to my Dad's house which was in the same area that we were moving. After we were settled we did the change of address and have not had any problems.

Well forget what I just wrote about not having problems with address change, as soon as I posted it, my dad called and said they'd recived something from Homeland Security. I told him to open it and it was my husband's approval letter...weird. Everything else we got at the house except for the initial NOA....

Hi Van2006,

In my opinion, I think you should "wait until after you move (July 1) to file the I-751". Personally, I don't think anyone should trust the USCIS in updating new addresses/information while the case is procesing/pending, as are somewhat incapable in doing such properly or are not doing this at all, despite you updating them on your end. You definitely do not want to risk your paperwork from the USCIS getting lost and/or delayed in the process, as there could be serious consequences there (such as not getting your 10yr green card at all).

As long as you are filing "within the 90-day filing period before your 2yr green card expired", the you are fine here.

When you do move, don't forget to file both the AR-11 (Alien Change of Address), and the I-865 (Sponsor Change of Address), and to forward your mail with the USPS, to update you address change. As well, use your new address as the main mailing address when filling out your I-751 application forms too.

Lol...heck, I've even told my husband that "We're not moving at all, until I get this actual plastic 10yr green card!", and he understood about that, even though he wanted to move before then. Meanwhile, I'm still waiting to move, and am still waiting for the card, to which I posted about in detail here recently: "I-751/N-400: Moving Soon...Help!!!, Paperwork help needed..."

Sorry for the post earlier. I read your post quickly and thought you didn't apply on time. Thanks to *Marilyn* for pointing out my mistake.

Please do fill in your timeline, it would help other VJers to know more about your situation.

It seems your GC will expire end of August. Like everyone said I would suggest you to wait. Following are my suggestion.

If this is temporary move like 3-4 months and you can get the mail at the old address I wouldn't do a change of address because based on my experience and observation of other's scenarios with USCIS, USCIS doesn't normally update your address if you are done with them, meaning no pending case. USCIS normally updates your address if you file a new case. If you do change of address after you file a new case with them, chances are they might or might not update your address, which has happened to me and others, because they have to locate your info and then update it and normally they are not efficient regarding updating the resident/alien address. Yes address change is indeed nothing more than a formality, but we have to do it.

If you are moving for a longer period, then do this please. Do an AR-11 online https://egov.uscis.gov/crisgwi/go?action=coa

Print (save the confirmation page) make a copy of it. Do USC spouse Change of address (http://www.uscis.gov/files/form/I-865.pdf )

List these two in your cover letter for I-751 in the list of documents you are sending to USCIS.

They will definitely update your address and will even send you NOA (Notice of Action i.e. receipt of acceptance) for change of address.

Collect the document till July and apply in the mid of July after you move.

Please remember to apply at least 1 month before the GC expiration, so that if they do send your application due to some mistake you have time to resend it again

and also because it takes USCIS time to clear checks (I would advice to use money order) and send NOA so that you can get NOA and biometric letter before your GC expires.

Hello Everyone,

Thanks for responding. That's what I will do then. We're moving to a new house for good..we're just waiting for the appraisal (and inspection) to be finished and we're targetting on closing around June 19.

I didn't realize it could take more than a year to get the ten-year greencard. Thanks for the heads-up. I do hope the NOA1 wouldn't take too long to arrive.

I'll try to fill in my timeline before the week ends. When I filed my AOS (almost) a couple of years ago, it was a nightmare coz I had to move. You can do everything by the book and you'll still find yourself not receiving mails, etc.

I actually did another boo-boo after that. So just a background---I got here Aug 2006, moved on Jan 2007, informed USCIS about it (I also had a case pending), missed some notifications etc, but still got everything settled.

Aug 2007 got my AOS approved, smooth sailing til then. Moved again on Jan 2008--FORGOT TO FILE FOR CHANGE OF ADDRESS FOR ME AND MY HUSBAND (SPONSOR)...remembered only on Jan 2009...filed it then....I HAVE NO IDEA IF THIS BOO-BOO HAS CONSEQUENCES :( What do you think?

I know it seems like we moved a lot...but we were renting and upgrading to a better apartment each time.

Nways, now it's time for one more move and one more dealing with the USCIS...whew! Hope everything will be ok.

And another question btw-- do you know how much it costs now to file for I751? The USCIS site says...400+ something and in parentheses "80 for biometrics". Do I pay all those using one check? Gosh it's been so long since I dealt with the USCIS I've forgotten these things.
