Who's Name do I use on the I-864?

My brother in law is getting married and has asked us to joint sponsor his future wife as his tax information doesn't qualify him by himself. My wife and I file our tax returns jointly and we're going to use both of our incomes. But the I-864 form is written to accept an individual, not a couple.

What's the proper way to fill out this form? Should I use my wife's name since she is a blood relative (sister) of my brother-in-law? Do I stuff both of our names on the form and just add both birthdates, etc?

Thanks.

J

One person per form.

If one of you has sufficient income there is no need for both of you to be sponsors.

If you need to combine incomes to meet the I-864P income requirement then one of you would complete the I-864 and the other would complete an I-864A. See the form instructions for all the pertinent details.

Actually your brother-in-law should fill out I-864 no matter what.

It is mandatory.

Petitioner should fill out I-864 regardless his/her income.

When you carefully read I-864 instructions, there is limitation for co-sponsor, too.

If you have to use combined income, you may fill out I-864A for both of you to make sure.
