Can a child attend school on a K2 visa before AOS is requested?

Hi all,

I was aware that I would not be allowed to work on K-1 visa until after AOS and greencard and that's not a problem (I'm in no hurry!)....but can my daughter attend school on the K-2 visa?

Does anyone know where USCIS / US Govt will have this topic discussed?

yes she can afaik :)

Even children of undocumented aliens are eligible for education.

Applied for K1

Met online 2001 - just aquaintances

Sept 2002 - 1st US visit - everything goes perfectly.

Dec 20th - Forms recev'd at CSC

Dec 27th - NOA1 received by snail mail!

Dec 29th - 'Touched'

March 10 2006 - NOA2!

March 23 - recv'd at NVC

March 24 - petition sent to London

April 9th - Pkt 3 rec'd!

May 17th - Pkt 3 signed for at London Embassy

May 24th - Medical

May24th - Pkt 4

June 14th - Interview 10am - APPROVED 1pm!!

June 16th - Visas received in my hot little hands 1pm :)

July 19th - flying to US!

July 27th - Married!! :-)

Aug 7th - Applied for SSN in married name

Aug 9th - SSN received

Why am I even bothering with all this if she can attend school?!

Federal requirement to provide K-12 to all.

But as a LPR/USC she will be able to obtain loans for higher education!

Your daughter can attend school without her GC, but you will have to get both your and her GC eventually. Once you are married to your USC spouse, you should apply for AOS for yourself and your daughter as soon as you possibly can.

Otherwise, you will both be out of status.

Do you know yet what school she will be going to ?

I looked up the schools on-line and emailed the principal before we got here to make sure I could get him in to the school and they may even send you a list of supplies that they will need - best to get them her though !

She was really helpful and told me what I would need to complete for paperwork and what to bring with me which was just his birth certificate and proof of vacinations.

Hep B is required but you may not be able to get them to have all the shots before moving here but that's not a problem as long as they do get them eventually as if they don't they can't attend.

If your child doesn't know imperial measurements - feet /inches then that's useful to go through that before you come and also the money. This will help with Math and also start looking at some American history too.

7/8/05 Green cards arrived for both my son and I

05/10/07 documents sent to lift conditions

05/24/07 letters rec'd extending green card and biometrics letters rec'd for 06/11/2007

06/11/07 Biometrics done in Milwaukee

04/11/08 letters received from UCIS transferring case to California from Nebraska service centre

My daughter had no trouble enrolling, as others have said proof of vaccinations are required. HepB was one of them so she had to get that one caught up. Also, good to have your child know the Pledge of Allegiance I did not think of that.. she had to learn it in English and Spanish here. I think she would of preferred to of known before hand. First day she came home all wide eyed and bewildered over not knowing the routine. Now she is an old pro though :thumbs:

Schools in the USA are a local issue - contact your local school board to find out what you need to do to enter your child in school.

Oh so true. My sister's boyfriend immigrated to the United States with his mother when he was 1 year old. His mom always told him he was a US citizen, but she neglected to fill out the proper paperwork. He attended public school, and graduated with honors. When it came time for him to apply for a passport and student loans, the poor guy found out that not only was he not a US citizen, or a permenant resident, but he also was the citizen of no country, having been born to a Cambodian refugee/migrant in the Phillipines.

Moral of the story - fill out all the proper paperwork at the proper time, or it will come back to bite you in the butt.

Any child living in the U.S. can attend school here.

The school at which I teach requires parents to submit a utility bill or rental agreement to prove they live in our area, and new enrollees need a birth certificate-to verify age. That is it.
