Medical Issues that may prevent AOS?

Do any of you have experience with your spouse coming to the USA that has a major illness? My fiance has MS, it's a final minor case. He can still move and function completely. He just has some weakness in his right leg. But, he does take medication that is rather expensive and of course, he's got some high risk for future degeneration.

I have read in some places that a major illness may cause issues with immigration, and I was curious if any of you were familiar with how that might impact our journey through this process.

Hi,

I am not sure about the immigration part, but the US is not the best place to be if you are sick and you do not have insurance. It will also be difficult to get insurance having pre-existing conditions. I can imagine that you have looked into this already, but if not make sure you do. Insurance can run you up 5-600$ a month in some cases.

My understanding is that for immigration they are concerned with communicable diseases that a person may spread. To my knowledge MS isn't considered communicable.

On a separate note, will your fiance be able to be covered by your medical insurance?

My wife has MS and has had it since 1984. she did not have any problems with her medical, She does daily injections of Copaxone and takes other pills as well. there are lots of help available for the cost of the injectable drugs if you need any info let me know.

When you have group insurance a spouse or child added is covered. There are some cases where there is an existing condition clause, but in our state, it's a state law that even if there is a clause (which it's unlikely for the group coverage) then after two years of being on the insurance they must cover his pre-existing conditions.

(I'm a licensed Health/Life insurance agent in the state of MN).

The independent insurances are very expensive, but I have looked into it and we can get insurance for him, even if I didn't have the group available.

Do you have small children or family that is keeping you here in the US?

My husband isn't particularly well either. Like yours, he is ok now but there are some dire possibilities in his future.

When we first met I told him I was 'planted' here because of my son. So - he moved here.

We are older than you and IF we wanted to transition back to the UK - well it would be easier on us if we didn't wait until we were 65! My son will be independent in three years or so. Who knows what our future holds? It's possible we may return to the UK if we feel my husband would benefit from nationalized medicine. I also love the lifestyle over there and wouldn't mind going from that standpoint.

when i was researching the medical exam my understanding is that a) they're looking to make sure you don't have communicable diseases and b ) you're not likely to become a public charge. if your fiance has his condition stabilised, that's they main thing they will consider.

04-06-2009 married

04-25-2009 filed AOS

05-22-2009 biometrics appointment

06-05-2009 EAD received

06-17-2009 NOA2 received

07-30-2009 interview- recommended for approval! GC expected in 1-2 months

10-21-2009 received NOA for the I-130: "your petition is approved but... the applicant for whom you are petitioning is not eligible to file for an adjustment of status at this time". still no GC :(

11-18-2009 welcome letter received!

12-01-2009 green card received!

september 2011 filed for removal of conditions

october 2011 biometrics appointment

december 2011 RFE received

january 2011 sent in RFE packet

february 2011 conditions lifted, 10 year green card received

Timeline

Most insurance will cover a condition if you can show you had medical coverage before being added to the new insurance. All UK citizens have a NHS card this proves you had medical coverage before.

My wife was able to get added to my insurance with no exclusion for her MS.
