Hi,

I am a USC living and working in Moscow, Russia. I know that since my income won't continue from this company once we move to the US, I can't count my income on the I-864.

My question is simply - which box do I check?

I'm not unemployed, but I can't count my income. Do I check unemployed since I'm unemployed in the US? Do I check employed and make a note that my income won't continue? help!

You list current income.

A few notes, I-864 requires a few things,

  • Recent IRS return (2008), even tough you may be exempt from paying tax in foreign income you are not exempt from filing a return.
  • Proof of US Domicile.

I kept paystubs, ect just in case (and they're even in English!). I suppose they'll figure out that my income can't be counted. =)

I made sure to file my taxes for 2008, and already have my transcripts ready to go. I'm hoping my bank statements and voter registration card will serve as proof that I've kept my US ties.

This whole experience is nerve-wracking! We're intending to use my husband's income to qualify, since he works for a joint company and will be able to continue working for them without changing salary/job title or anything after we move. But I've a friend who's agreed to be our back-up cosponsor, just in case.

You'd have to check that you're employed because that's your current employment status. I wouldn't put the note if I were you. Just my personal opinion...

You might want to call NVC and double check with an operator.

Yes, they expect you to put your gross foreign income on the I-864 - even though it will not really be counted.

So for instance:

2008 - U.S. 25,000.00 then a note to the side stating the amount in Russian currency.

Thanks again! I'd have done this all wrong . . they should include better instructions for the overseas folks.
