I received a case file review notice asking me to bring additional documentation. I had indicated "Yes" to Part 10 Section D question 16:

Have you ever been arrested, cited or detained by any law enforcement officer (including USCIS or former INS and military officers) for any reason? I indicated yes because I received a couple of traffic tickets (speeding - one in 1997 and the other in 2004) since I thought that traffic ticket violations fall under the category "cited".

Now the case review letter statement for additional evidence says:

You have indicated in your application that you have been arrested. For these arrests and any other incidents in which you may have been involved, bring originals or certified copies of all arrest records and court dispositions showing how each incident was resolved.

I dont have any court disposition records for my traffic violations. I have evidence of the fine paid for the violation. My drivers record only shows one of these offenses. (I have a certiifed copy of the drivers record on me to furnish as evidence if asked). When I enquired for court disposition records at the court, they said that they cant find my violation in 1997 on file and also mentioned that they have archived my 2004 case and they have no way to retrieve archived records.

Has anyone else been in a situation similar to mine? If so, how did you handle this issue?

Ask the officiating Court to send you a letter stating that they have no information on file for these violations. Ask for the letter to have the official court seal. Include that along with the rest of the evidence that you do have. I was charged with windsurfing without a lifejacket back in 1983. I went to court, paid a $10 fine and that was it. For a job situation back in 1994 I asked for a copy of my court record and got such a letter stating that the documents no longer exist and they have no record of the incident. I've submitted copies of these all the way through the process up to the Removal of Conditions where they wanted an original letter so I sent the original and requested another copy from the Court for the Citizenship application. If the documentation doesn't exist there is not much you can do about it except prove that you tried to obtain the evidence and submit the paper trail of your attempt. I suspect you won't have too much problem since they were traffic incidents. Good luck.
