Hi,

I've been told by alot of people that if I have questions this is the place to go to.

I well my fiance and I are lost and confused about everything.

He's in the US navy, and I'm Canadian

Originally we had planned on doing the K1 fiance visa route, but he's looking at being deployed sooner so we are going to get married sooner then we thought. Like... this summer soon

so I guess my question is the K3 verses the CR-1

am I able to enter the states why we wait on immigration, because right now we try to see each other about every two months and because he doesn't get alot of leave days I end up traveling more then him. However if he does end up deployed it won't matter. Did anyone have better luck with one over the other, is one easier? why are there the two?

I'm sorry about all the questions we're just so confused and overwhelmed with everything kinda being thrown at us now, any tips or help would be amazing, and greatly appreciated, I'm sorry I have read as much as I could but I'm just so lost.

the uscis website has a whole section for military help, right now we are attempting to get our K-1 stuff expidited using the military help line infos if you check the page u might find something there that could help?

Hi sarahrice and welcome to VJ! If your USC fiance is going to be deployed, when he gets his papers, or notification from his employer about this, you can file this to have your case expedited as a K-1 and hopefully not have to wait long. See Inky's link for this. If you decide to marry this summer, you can file either a K-3 or a CR-1. In Canada, if you apply for a K-3, you are interviewed in either Vancouver or Montreal, but all CR-1's get interviewed in Montreal. Please see the guides as to what might be a better option for you.

The K3 was introduced at a time when the IR1/CR1 was taking a long time to process. It has some similarities to the K1, such as the beneficiary has to come to the US before adjusting status.

Apparently, there is no longer much difference in the processing time, so many people here advise against the K3, and recommend the IR1/CR1 instead. The IR1/CR1 has the advantage that residency is granted upon entry to the US, which will save not only time but a considerable amount of money. The residency will be conditional if you've been married less than 2 years.

One disadvantage to the IR1/CR1 is if you have older children whom you wish to bring with you as derivatives. The IR1/CR1 only gives derivative status to children who were under age 18 at the time of the marriage, while both K1 and K3 allow any child under age 21 to get derivative status. In any case, you must apply for AOS for derivative children before they reach age 21. Of course, derivative children cannot be married. If you don't have kids, or you don't plan to bring them with you, then none of this will matter to you.

Hi sarahrice,

If your fiance will be deployed and has his order, he may request for an expedite on either type of visa you apply for. If it gets approved, it'll make the whole process much shorter. You may call the military helpline, however there's no guarantee you'll get the right person who can help you with the case. You may have to try several times. There're also other ways to do it.
