Need your advice

SO lost his birth certificate long time ago. He went to Nigeria 3 weeks ago. He went to the registry to get a certified copy of his BC but since he didn't have the registration number and they aren't computerized they would not search through 40+ years of certificates looking for his - don' t blame them. BUT what they did was generate a new one for him and the "authority" signed it with a date in the year SO was born. SO didn't feel right submitting that one so he went to the courts to get an affidavit of lost birth certificate - which I have the original BUT he doesn't have the secondary support. His parents are both deceased and there are no other records. I didn't realize he was getting the affidavit otherwise I would have told him to have his sister write an affidavit of support. He didn't send me the BC that was generated because he didn't want it sent he wants to be completely honest. SO............................ what do I do?

OPTION 1: Send the affidavit and hope not to get an RFE for not having secondary support

OPTION 2: Have his sister write up the secondary support WAIT ANOTHER two or more weeks for it to get here before sending in the DS-230

OPTION 3: Send in copy of birth certificate with a note that original will be shown at interview and risk being found out that it's not the "REAL" original.

We are right along with you. We filed using an attestation of birth which came from the National Population Commission alonf with the birth cert. which was generated in 2004 when he got a passport. Since we are still waiting....it will be interesting to see what happens. Many people don't have birth certificates so the attestation of birth was the only way this could be resolved for us.

I'm interested in what others have to say about this as well. So far we have had no RFE.....but it is still very early.

We are right along with you. We filed using an attestation of birth which came from the National Population Commission alonf with the birth cert. which was generated in 2004 when he got a passport. Since we are still waiting....it will be interesting to see what happens. Many people don't have birth certificates so the attestation of birth was the only way this could be resolved for us.

I'm interested in what others have to say about this as well. So far we have had no RFE.....but it is still very early.

Just curious why did you already send in a copy of SO's birth certificate? It isn't required until you reach the IV Packet stage.

So we are taking OPTION 1 except his sister is sending me the affidavit tomorrow so hopefully I will have it in hand IF we get an RFE so I will be able to send it right away. We both decided that presenting the birth certificate that was generated 3 weeks ago and backdated 42+ years ago was not a good option and could be view as being fraudlent.

We just sent everything we needed needed the birth certificates as part of the process to properly legalize our marriage in Italy, so when I filed I submetted all of the legalization documents including my apostilled Birth certificate for use in Italy and his birth certificate as well. I've heard a few stories of marriages not being considered legal because certain steps were not followed. So we wanted to do everything correctly. Also since my husband is originally from Nigeria, we decided to be safe and include affidavits from family and much more. it will all be resubmitted later as well. We just decided to get everything ready to go from begining all the way through NVC (even though we are not there yet. We have a baby on the way so are hoping to avoid any RFE and any unecessary delays that might happen because we don't have something yet.

I'm just glad I found VJ because the guides were wonderful as well as all the advice I found here. We probably over dosed on the proof and documents with the petition but better safe than sorry.

Yes just like you cornbread, i submitted my husbnads along with all other relevant documents just to be sure and in case. And mine also has his from the National Population Commission only it has a record number and validation along with a Sealed High Court Judicial Division of Statutory Declaration of Age validating age and place of Birth in Nigeria so prayerfully all is well . Anyway I sent copies of all just to be safe!

Is your hubby in Nigeria still. Maybe he can get another copy and have them write date of issuance (instead of making up a date from the year he was born).

What do you mean my secondary support from his sister?

Also, could you just submit what you have to keep the process going and then provide the rest at interview?
