hi to all , i am male and i filed I-360 15 Sept 2009,kinda complecated case but let me explain u , i never lived a single day with my wife in USA but we lived together in My home country, she got pregnent and decided to come back deliver the baby and go back to my country ,i was in pak,after she move back she changed her mind and want me to come to USA ,was hard for me to come on that time was not ready but anyway she applied for visa i got my visa ,we was in touch on daily basis, anyway long story short she brought me here but from very 1st day i got in toruble she dont apear on aiport and i try to struggle for life ,anyway now i filed a I-360 last year ,,ohh i came to state in Aug 2007, we got married in dec 2005 , so far VSC ask twice more evedance but nothing else we provide all of the evedance ,but i m confuse wht i is prima fice and when i suppose to get it ? anyway help and reponse will be appriciated ,

It means that on its face you appear to have sufficient cause to request relief. In other words, once you submit the forms and your personal declaration to USCIS uner VAWA, a preliminary review is made of your file to see if you have any basis for a claim or not. Once a prima facie determination is made, the case will proceed to review, where the Service will interview you and adjudicate the application. This takes time, quite a lot of time, so the preliminary determination helps to at least permit the alien to secure aid, if eligible, while the application is being determined.

We got More Evedance Letter from vSC on 27th of Feb ,and we send all the required Documents ,Joint Bank Statement , Reference Letters from Friends and From my Family in pakistan, when my wife pregnent in pak letter from that Lady Dr where my wife visited 3times in pakistan , I have one question when i suppose to Get Prima Fiace ,and another question do i qualify for any Govt Aid or anything ,its getting hard to survive here but anyway Plz help me to find out more about I-360 Prima Fice ,,,,and when i suppose to get ,

In general you should received a prima facie after 3 weeks if you eligible.. i received mine after 26 day

Most vawa cases are in removal proceedings and the judge will give you more time till you get a decision from VSC (most likely you have to submit prima facie to the court ) don’t worry if you have sufficient evidence

From what i know and searched prima facie doesn’t mean that you 100% approved and if you don’t got prima facie doesn’t mean that your case will be denied one of the member her got 2 RFE and no prima facie and she got approve

Okay.....prima facie determination is mean that you are eligible for i-360 self petition under (vawa) and you can receive benefit from the government (while the application is being determined).. Like food stamp (no cash) and this deferent from state to other ....... and you can apply at family and job department for the benefit

I applied for I-360 on 17 September 2009 , we got First REF Evidence in Nov 2009, Then in Dec 2009 and Then More Evidence on 27th Feb 2010,they are kept asking for More Evidence and we are providing Continusely, i was going through Psychiatric Dr ,and also for Therophy,But im still confuse about Prima Facie Determination ,when they Issue and why i dont get it till now ? so plz explain me wht are the most required documents they need ,i send Marriage Certificate,Bank Statment, Letter which she Wrote to me ,My Daughter Birth Certificate which i got here , All the Proof that i visited where my wife lives now adays , So plz Help me out to understand all this ...

"RFE" means Request For Evidence.

You keep getting RFE's for evidence, and you haven't gotten a prima facie determination yet, because USCIS is not satisfied with the evidence you've provided up until now.

The prima facie is only one of the first steps, and it's not a terribly difficult one to achieve. If you have credible evidence that, if presumed to be true "on it's face" would prove that you were abused, then you can get a prima facie determination. One very important factor that you may not have realized is that, with few exceptions, the abuse MUST have taken place in the United States. Letters from your friends and family in Pakistan do not prove this. Letters from doctors in Pakistan don't prove this. Statements from joint bank accounts do not prove this. All of those may be sufficient to prove you entered the marriage in good faith, but they don't prove you were abused in the US.

Letters from psychiatrists and therapists may be good evidence, provided they demonstrate you are suffering from psychological or emotional trauma that is the direct result of the abuse you suffered from your wife. Again, that abuse must have occurred in the United States.

The fact that you never lived with your wife in the US is going to make it very difficult to prove she abused you. Sorry.

I also have WAVA filed and have Benifit letter renewed twice. My WAVA is pending since April 2009. Adjucating time in VSC is 5 months. Did anyone knows what to expect next?

CAN I renew the driving license with Benifit letter?

nothing yet... It's say on the last update that I shuld recive an writen decision with in 60 day and that was on nov 4 2009 and I still waiting.

It's say on the last update that I shuld recive an writen decision with in 60 day and that was on may21 2010 Vermont center recieve our evedance wht they have requested ,The reference letter i got it are from USA from my friends ,and dont u think this is abuse that she dont came to pick me up from Aiport, and was hidding from me ,and was not letting me see my daughter untill today ? and im going through the Pshycatric and theropist regularly basis ? ya i dont have any phisical proove that we lived together in state ,but dont u think that she abuse me verbaly and the gifts and letter im sending to my daughter getting back regularly? dont u think this is emotionally abuse for the husband the wife betrayed and not support me from very 1st day i arrived in state ?
