Can you immigrate to the US by opening a business?

Hello, can you immigrate to the US by buying a business in the US? We would like to open a business in the US and need to know if this is a good way to immigrate?

Yes, I believe you can - with the E type visa.

Treaty Visa E

However, this is a 'non-immigration' visa - means you have to leave if you stop the buisness. You cannot AOS on it.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Probably not. If you read the info at the link - this may apply:

The investor must be coming to the U.S. to develop and direct the enterprise. If the applicant is not the principal investor, he or she must be employed in a supervisory, executive, or highly specialized skill capacity. Ordinary skilled and unskilled workers do not qualify.

The investment must be substantial. It must be sufficient to ensure the successful operation of the enterprise. The percentage of investment for a low-cost business enterprise must be higher than the percentage of investment in a high-cost enterprise.

They would probably need some sort of work visa.
