Though I am presently employed with the economy the way it is it's possible I could lose my job any day now. So this is just a theoretical question. Say I had an employment letter dated today and I lost my job tomorrow and my Fiance's interview was one month from today. What would happen if I used the letter for her Affidavit of support? Would it still be valid? How often do they follow up and contact the employer?

The employment letter isn't as important as the last 3 year transcript. Do you have those, and are they over the pverty level?

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

im was under the assumption that for the interview you only need your most recent tax transcript, if you have your past three then great take that with you but if you only have one you will be fine..

Three years is a best practice, not a hard requirement. Employment "letters" are valid the day they are dated and are generally accepted as "current" if the date is reasonably current. Certianly 30 days is current enough and usually so is 90.

Facts are cheap...knowing how to use them is precious...

It is not theoretical at all.

The defining document here is the I-134. The letter is a support to that document. It is completed and signed in the "present tense". If you complete and sign the I-134 today you are employed and it is absolutely true, attach your employment letter and you are good to go.

If you lose your job next month and complete the I-134 next month and claim this job and attach the letter it is a material misrepresetaion...fraud. I have never heard of them following up with the employer for an I-134. The I-134 is a very temporary document, it will be replaced with the I-864 for the AOS.

I suspect and believe an I-134 and all supporting documents attached and completed today would be perfectly accpetable in one month. I hope so. I sent mine with my wife to Ukraine for a K-2 interview next month. It will be about 6 weeks old when we present it, I am not worried. There is no particular time limit for the I-134. The I-864 requires all documentation be within one year. The consulates usually apply the same rules to the I-134, but they CAN ask for more recent documents. I doubt they would for the I-134, especially if it is within 2 months.

Each consulate and each case can be specific, so be aware of that.

Consider yourself lucky, we just announced a massive re-org today although we've been lettiing a few hundred go over the last several months in small stealth rounds of layoffs. A buddy called me today to tell me my name was not in the box for the new re-org where it should normally be. So, perhaps tomorrow or friday will be my last day. These things usually happen on a Thrusday or Friday and especially at the end of the month.

Last week, I sent in my I12F and they've cashed the check so we are now into the process and I will be unemployed shortly-arghhhhh. I can provide the 3 years of tax transcripts of very good income but it will be forshadowed by my unemployement income which i believe they will accept. Its about $586/ week here for me so that would put me within the range of 3 people I believe. Co-Sponors are not available to me so I must make this work on my own.

A buddy called me today to tell me my name was not in the box for the new re-org where it should normally be. So, perhaps tomorrow or friday will be my last day. These things usually happen on a Thrusday or Friday and especially at the end of the month.

Last week, I sent in my I12F and they've cashed the check so we are now into the process and I will be unemployed shortly-arghhhhh. I can provide the 3 years of tax transcripts of very good income but it will be forshadowed by my unemployement income which i believe they will accept. Its about $586/ week here for me so that would put me within the range of 3 people I believe. Co-Sponors are not available to me so I must make this work on my own.

Let us know if it is the case. There is considerable debate about this. Unemployment is not specifically excluded as acceptable income, but it IS temporary and the consulate makes the call. They do not have to accept this as income. I have not yet seen any reports of anyone meeting the qualifications with unemployment benefits and nothing else. I am not sure if Manilla accepts co-sponsors, some here say "no", some say "yes" IF it is a family member. Check it out in the regional forums. Best to ask a direct question in a topic you create to get specific answers

I'm in the same situation as you. I called up US Embassy in Manila twice & told me they do not accept Co-sponsors for K1 type petitions w/c uses I-134 form. If it's a family based petition then co-sponsors are accepted. I ask them why they don't want any co-sponsors at all? She said sponsors should be the one financially responsible to the applicant not the co-sponsor. It is difficult for an unemployed sponsor to support the applicant once he/she is in the US. Ultimately, the final discretion is the consul. One member here mentioned w/c is in the same situation as ours that her fiance got the visa despite the rejection of his co-sponsor. The consul determined that the fiance in her line of work can easily find a job once she's in the US & would not be a public charge. Please call the US Embassy in Manila below. Please post any info you got to help other members here. Thank you.

Unemployment IS "income", so the issue is not whether it will be accepted as income but whether the Consular officer will consider this kind of income as sufficient evidence the intending immigrant will NOT become a public charge. That's what they are evaluating, not what is income and what isn't. In this evaluation, they consider the totality of circumstances. The petitioner not currently having a job, is a major factor in the circumstances being evaluated.

In my case, I will bring tax transcripts of the last 5-10 years showing income $125k-150k yearly. Yes I will be made redundant shorlty but I'm a good wage earner and frankly, im willing to sell most everything in order to get my finanaces in tiptop shape and plough even more money in to savings while I still can. So, hopefully presenting my past jobs and related earnings, my savings and unemployment of $586 /week to augment my the delta omon my earings will be the foundation of my argument/presetrnation to the CO. If not, well there is always Plan B and C ,one of which, includes moving to Canada where she is already employed and is very happy living there. Since I wont be allowed to bring them, Ill just have to store my guns with one of my daughters since the only folks in Vancouver that seemed to have them right now are the gangs and police - oh and maybe Ma and Pa Kettle from back in the day.
