OK ! My Cr1 Visa expires on 8/22/09. I sent out I-751 on 5/23/2009. Thinking it will reach them on 5/26/2009 which is within the 90 day filing period. Could someone clarify if they will count 5/23 as the filing date or 5/26 ? Thank you !!

CR1 visa? don't you mean your greencard?

I would think the 90 days is calculated from the date they log it into the system

It should be 90 days from the day they start working on the forms received, so you should be ok.

05/10/07 - NVC receives petition, case # assigned

08/08/07 - Case Complete

09/27/07 - Interview, visa granted

10/02/07 - POE

11/16/07 - Received green card and Welcome to America letter in the mail

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

You should really read this thread. The OP had his/her package returned. You should count the number of days in each month (not just approximate it) and the USCIS apparently counts from day of mailing.

I'll be interested to see what happens to your package though and learn if the case above was a fluke or not.

Feb 23 - Sent USCIS a message asking for a processing update

May 6 - Received an email response saying things were progressing normally but that waiting times might be longer

Feb 25, 26 & 28 - got emails saying that the cases had been transferred to another office, then to my local office, and then just transferred and are being processed

Mar 17 - got email, attached to one case number only, saying that my A number was changed relating to the I-130 filing

Yep read the thread and I would think that they would consider the recipet date as the date of filing. As far as this girl's case is considered her filing date was 5/23/09 and they recieved it on 5/21 which is 2 days early. In my case they would have recieved on 5/26 which is like 89 days. I hope that how it works or else oh well !! I would just have to re-send it !! No big deal !! Thanks !

Hi Geek,

As long your application is not before 90 days or after your GC expires you should be fine. So if you file even 60 days before GC expires you will be fine. They say "Hast makes waste' and ' You snooze, you loose' so as long as you are in between you are fine.
